Hello any help on this matter would be much appreciated.

Today I received a parking charge from Combined Parking Solutions. The driver was a bit confused as they was parked in their gyms car park. The driver contacted the gym and they said they were not associated with the above company nor had they issued any tickets today. They did however advise that it is a shared car park and therefore they may have been in another company's bay. The driver was not aware of this as there was no markings they also park in the same bay whenever they attend.

A few people have told me to ignore the fine. I'm a bit split on whether to pay the lower fee of £60 or appeal it and risk paying £100. If anyone has any experience on this matter any advice is welcome.

    start by reading the NEWBIES sticky thread at the top of this forum, and check which ATA they use for appeals too

    There are broadly 2 different types of threads on here.

    1. I did wrong - help me get out of the charge.
    2. I didn't do anything wrong - what do I do>

    It is important to see which category you fall into, so suggest you find out and let us know. It is far more satisfying to help with an appeal where the PPC have got it wrong than supply you with stock appeal points for a technical knock out.

    So go back, check the signs and come back to us.
  • Also check for certain that where you park is the gyms, it could easily be CPS "accidentally" going beyond their shops remit.

    also, this is a public forum that anybody can read so as most parking scumpanies including this one read the forums, it means post #1 reads like a statement for the "prosecution" (claimant)

    people are taught to write in the first person, but this is a no no when it comes to court claims, which this could end up being

    will these "some people" also give good legal advice when or if that time comes ? (I think not , they will fade into the woodwork because they clearly havent got a clue)

    I was thinking about this the other day, and I don't think enough is made of this. Perhaps something like this should be added to the start of the NEWBIES thread:

    The parking companies often read this forum. With this in mind, it is strongly recommended that you always refer to the driver in the third person to avoid the risk of incriminating yourself.

    No "me" "myself" or "I".

    If you have already posted, please go back and change it if necessary.

    Thoughts?

    The same goes for any other detail that could possibly identify your case, such as the exact amount of any claim, exact dates and times (just the date will do, a rough time as well, if pertinent).

    I remember a case earlier this year where someone had received a court claim, and posted the exact amount in their post on here asking for help. The claimant saw this and the person concerned got a PM saying "gotcha!" or words to that effect.
    I would be cautious and say no more than a "three figure court claim" or something.

    I personally think that a clear warning along the lines of what I posted above needs to go to the top of the Newbies thread.
  • I wonder if this is a self ticketing situation and the ticket has been issued by someone from the company that the gym shares the car park with?

    If so it might be worth asking them to show where they think their territory ends and to show where this is indicated to users of the car park.

    The only markings on the bay's are numbers some have companies names marked on but the bay where the driver was parked was just a number.

    Is it worth writing an appeal explaining that the driver is a member at the gym and it was a honest mistake or take the advice of ignoring it?

    there is no advice stating that you should IGNORE it, that would be foolish since POFA 2012 arrived 3 years ago (in england and wales)

    I am not sure that you have edited enough of post #1 either , not unless the pcn came in the post ;)

    only the actual landowner can cancel the ticket, or the managing agent (depending who the contract is with)

    these parking scumpanies just want your money, they are not interested in "gewnuine mistakes", they make most of their profits from "genuine mistakes"

    not being funny but you need to wise up, asap

    these are money making sc@ms where the public is duped into breaking a rule that costs them say £100 , doesnt matter what the rule you broke was, or why

    if they want 10 holidays a year and to run around in a jag, they need people like yourself to make many "honest mistakes"

    if the gym didnt contract them, the gym has no sway over them, especially if its a shared car park (like many are)

    No. PPC s don't do mitigation and you would be admitting you contravened. Bad move.
