The question I thought you'd ask is "should I accept the £175 compensation awarded by the FOS?"

Several of the questions asked by some of the other posters would help inform a view on this.

I can see your point, but would still need to explain the circumstance leading up to the compensation.
  • The ombudsman has suggested you get £175 compo - you won't get more from the PO - unless you sue and win.
From what you have posted there is every chance you could get less.

To be illegal, it would need to have been attempted theft/fraud. Was it that? I could possibly also imagine a computer misuse offence (maybe). If it wasn't either of those (and you'd need proof) then it isn't illegal.

BTW, reading the context here, I think that it was probably a Standing Order rather than a Direct Debit.

Thank you, it wouldn't have been such a big deal if this hadn't of been a long series of mistakes by them which impacted on my ability to manage my money.

I wouldn't go down that route, but we'll see, as they tried to blame my bank when in fact they didn't investigate properly.

Did your bank or the Ombudsman actually use the word "tampering"? I find this implausible.

What were their actual findings? This could help us understand what they accept actually happened. (Or do you dispute their findings?)
This was the findings after the investigation.

I have evidence it was vindictive, which was sent to the FOS, however I deliberately didn't go into detail as I said at the start of my post- to cut a long story short. I am aware it's not fraud but was asking if what was done had a 'title', if not, it's ok. This was an automatic transfer from one bank to another, no changes should of been made during the changeover process and certainly not without authorisation.
If this sequence of events involves personal details that you can't disclose here, then exactly what happened will have to remain a mystery to us all. There probably isn't a name for it though. Taking what you have said at face value, the FOS has offered you a generous settlement, which is only supposed to take into account the actual impact of the event on your finances and time. It cannot be set at a level that punishes the company - only a court could award punitive damages. So I would suggest you accept it and move on.

Thank you for your help, the FOS have now said, given all the facts that they will negotiate with them for a higher amount.

When I originally spoke to them today, I hadn't sent them additional information relating to all that had gone on. Its too late for the F.O to speak to the right department now but hopefully it will be settled by tomorrow.
