Hi all,
I have read a lot of posts on various forums about this, most say to ignore but some say you still have to pay, looking for some advice.
I parked in an empty car park on a Sunday evening a while back and a short while after got a parking fine, everyone told me to ignore it as they can't enforce it or take any action, however since then I have been getting regular letters from DRP threatening to take me to court if I don't pay the £128 fine which will rise to £160 if I don't pay within 7 days.
They talk about complying with pre-action protocol before the need for court proceedings
Can anyone give me some advice whether they are able to issue any kind of action against me, i.e. CCJ etc?

where did you read "ignore"?
secondly who issued the ticket?From the Plain Language Commission:

a debt collector cannot take you to court for this
I doubt they even said they were going to do this in your paperwork
they probably said you "may" be taken to court
or that they will recommend to the creditor that they take court action
read the paperwork again, it will have sentences mentioning the above, beacause they are trying to scare you into paying the alleged debt, they will use weasel words to try to do this

Care parking could try a court case (very doubtful) , but DRP will definitely NOT be issuing a court case because they do not "own the debt" , they are acting as agents for Care parking
they dont get paid unless you pay them , because they added their fee on
after 6 years, its statute barred (in england and wales)

if this happened in england or wales then your friends are idiots, because the law changed 3 years ago and you should have appealed the parking invoice from Care
in future, appeal , dont ignore

This forum has not advised ignoring since 2012, so you really need to check dates when looking at information on the internet, and even then it is not necessarily correct.
As advised above, the NEWBIES thread is your one stop shop for all private parking queries, especially post 4.

DRP will offer a reduced payment then they will write to you again using the Zenith Company paperwork ( same company) - below taken from their web page -- same company number

Dont panic, dont phone them, most people would say dont write to them, a few on this forum advise writing to them and deny the debt --- but the final choice is yours

Thanks for the info, Sorry for posting this, I only found the sticky after you pointed it out. Its worth saying that one of the people advising to ignore is a police officer!, as about 4 separate people parked in the same place at the same time got a notice and we've all been advised to ignore it. I shall look into it further, but yes you are right the head says:
'Reduced payment offer to avoid potential court proceedings'
The also say 'recommend their solicitor to commence court proceedings against you'
They state its 'their clients final offer to settle the case'
I shall have to spend a bit of time reading the stickies as theres loads of info in there,

Police and solicitors are two of the least well informed groups on private parking issues. They're definitely on your 'ignore' list in this context.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

With some PPCs who never have done court, then it may be safe to ignore. But who knows when they might start?
We recommend appealing and taking advantage of POFA 2012 in all cases.0 -
police officers are not trained in civil law, most solicitors and CAB dont know this topic either
the best advice is this
STOP READING THE DEBT COLLECTOR LETTERS !!
do not open them , do not read them , do not post about them
if Care parking send anything, or if court papers arrive in the next 6 years, deal with those letters
in future , appeal parking invoices to the parking company, in good time0
