Fined ukpc own space twice in a week

Hello all

So I've just purchased my first house and have been living here a week.

The property is freehold and has a designated space in a shared car park 'serviced' by UKPC.

2 days in I forgot to display my permit and low and behold there is a notice on the windscreen requesting payment of £60.

Today my parents come round whilst I'm at work, park in the same space and get slapped with a fine.

My mother is understandably upset and I am quite frankly furious.

Have read quite a bit on here including the newbie thread (seems aimed towards parking on commercial properties) and was after some advice.

1) I made mistake of appealing first notice issued to me which means these clowns now have my details
2) parents have not yet appealed or taken any action

I've not checked the deed documents yet as I don't have immediate access to them. Would very much appreciate any advice.

    These are not fines, they are speculative invoices. Do not pay, do not ignore, do not 'phone a parking company, ever. The Stickies cover parking on private land, which may or may not be commercial.


    UKPC have recently been investigated for fraud having been caught fiddling time stamps on photographs, so don't panic as they are unlikely to progress this to court, although they will try to intimidate you and your parents.


    It's a shame you appealed as you probably gave away the fact that you were driving thereby throwing away a valuable appeal point. Never mind, all is not lost.
    UKPC must provide you with a PoPLA code and that is where you will beat them. They may ask for more info but just wait until you get the code, check it is valid, than appeal to PoPLA and win. You have time to research other appeals in the POPLA decisions thread that are similar to your case.


    Meanwhile, make sure your parents appeal AS KEEPER, not driver around day 25 from the date of the event. Use the template appeal letter in theur NEWBIES thread exactly as it is, making absolutely sure they do not reveal who was driving.
    They then make a second stage appeal to PoPLA if/when the first appeal is rejected.


    Take pictures of signs and make redacted copies of the windscreen tickets and post them up here.


    To post pics, upload them to a web hosting site such as tinypic or photobucket, then post the URL here, but change http to hxxp as Newbies can't post links. Someone here will then convert it for you so everyone can see it.


    As you have already said, you need to check the Ts and Cs of your lease/deeds as this will trump anything the parking scumpany says. If you own the parking space, even better.

    Deed access is via Land Registry website. Don't worry if it hasn't been updated, the plan of what you bought should be the same.

  • Do you own the space ?
    If so as they would be operating a tri-party agreement system, you can sack the agent of the management company (parking firm) as you have equal power in the agreement.
    Also what does your freehold state in relation to the space.
    I do Contracts, all day every day.

    What are the arrangements for permits for visitors?

    Who owns the shared parking land?

    Do you own the freehold of the parking space? (You MUST check that with your deeds)

    You might want to talk to your conveyancing solicitor to get him to confirm what the searches brought up in regard to the parking arrangements.

    Please note - this isn't suggesting he represents you to fight the parking charges (even pro bono), he won't know as much about this stuff as regulars here (and that's not an idle boast). Seriously, solicitors are not up to speed on the private parking sector.
