Google Play charges added to "Capped" mobile account

When I started a mobile contract for my young son, I made sure no extra charges could be added to bill. I arranged it via a call to customer services that he could not run up a bill above the monthly amount.They never said there would be any exceptions. This month my son managed to add £50 to the bill by clicking on in-app purchases within games. As the google account has no card details on it apparently gave the option of adding them to the bill. And that's what happened.
I believe that following the original call Three should not have authorized the transactions. I've now been told by them that its automatic and they have no way of stopping it.
So I want a refund , but they refuse. They tell me to take it up with the third party provider. But my contract is with Three. Three are the ones who allowed the purchase to take place. The original conversation did not say there would be any exceptions where charges could be added. And I feel that's why they should refund me.
As the refuse to refund I'm very tempted to go down the small claims court where my fee would be £25. But as I want to stay with Three for my own use it crossed my mind that they could just cancel my contract if they wanted to! Or is that getting too paranoid ??

    If you refuse to pay then a high chance of them cancelling your contract and putting negative marks on your credit file.

    I would pay them and make a formal complaint, when they fails which is likely take it to the ombudsman whatever it is this week. If that fails the consider court action.

    If its https://www.payforit.org handled transaction fight it, 3 own 25% of the organisation with Voda, o2 and EE.
    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)
