    (5)The relevant period for the purposes of sub-paragraph (4) is the period of 28 days following the period of 28 days beginning with the day after that on which the notice to driver was given.

    Either will do. The one you asked about earlier doesn't shoot you in the foot and lays out the fact that you've done a bit of research so won't be an easy push-over. It won't harm your case to send that.

    If using the newbies sticky template then [STRIKE]PoFA[/STRIKE] POPLA needs to be omitted. Edit - POPLA, not PoFA!

    Remember - £10 to your charity if it gets a cancellation; £20 if they pay you at £18p/h.

  • Received a response today saying:

    That as I am the registered keeper they are entitled to proceed on the basis that it is more likely than not that i was also the driver. In civil claims they are obliged to prove that I was the driver on a balance of probabilities. They are satisfied I was the driver because 1. I have not identified the driver in question and 2. I haven't produced any evidence from a 3rd party e.g. witness statement or a letter from the driver.

    Advice please?!
