POPLA then IAS being offered by same operator??

Hi All

I need some advice as have had 2 parking notices, within a week of one another - from the same company.

- The 1st I have appealed through POPLA as was given a reference for this and advised this was the thing to do if my initial appeal was rejected by operator.
- The 2nd, they haven't given me the option of appealing through POPLA. ie no reference to POPLA on the operator's appeal rejection letter.

My understanding from these useful forum threads, is that we as consumers, have more chance of a fair appeal by POPLA.

Can anyone advise why they haven't offered the chance to appeal through POPLA with the 2nd notice?

Is this correct legal practice? - Thanks in anticipation for any advice or help.

    They jumped ship from the BPA to the IPC on the 1st October.

    If your first event took place before that date then they would need to offer you POPLA. If the second event took place after that date then they would offer you IAS.

    Will be an interesting scenario if both parking events were identical, your POPLA appeal is upheld, and you appeal to the IAS on the same basis.

    When is your POPLA appeal due to be considered?

    You have 21 days from the rejection of your 2nd ticket to appeal to the IAS - hopefully you can get your POPLA decision before then.

    Yep, in between the PCNs, UKPCM moved from the BPA AOS to the IPC version with no appeal worth trying.

    So the important thing is to concentrate on the POPLA one and I'd ignore the other one now. You need to rebut UKCPM's POPLA evidence pack when you get it, or complain to the BPA if POPLA's portal says the evidence has arrived (the second tick) and that it's going 'for assessment'. That's not fair if you get no copy 'evidence pack' to comment on, so keep checking.

    Email to complain to the BPA if it looks like POPLA have got their copy, but you don't, is: aos@britishparking.co.uk It won't matter that UKCPM have left the BPA, they can still ensure the POPLA process is followed. Do not contact the IPC!

    It will be the date of the actual parking event which is crucial as to whether POPLA or IAS appeal route is appropriate, not the actual issue date of the NtK.

    My status with POPLA is just at 'in progress'.

    This isn't very helpful as I am wanting to see the outcome of the 1st appeal and then decide whether to pay at the reduced rate.

    At the moment, I only have until the 5th to do this.????

    You don't have to pay anything unless you are ordered to by a Judge. Losing at POPLA and/or IAS places no requirement on you to pay at either reduced or full rate.
