Debt collectors letter

I received a letter from debt collectors for a PE ticket issued since April 2014. But I don't recall getting such a ticket.

The only 2 tickets I received from them one was granted appeal by popla and the other is still waiting for popla.

I wrote to the debt collectors to ask if they can send me a copy of this ticket as I didnot receive it and they wrote back to say my appeal time for this ticket has passed so I should pay up.
They said if I ignore it then I might get court papers .

The dates on the 2 tickets I have don't match the date from the debt collectors letter.

So please what should I do, I don't recall getting this ticket

Thanks

    Have you moved address recently?

If not, write a complaint to the BPA Ltd complaining about PE's non-compliance with the Code of Conduct in instructing a debt collector to pursue you for a ticket for which you've received no Notice to Keeper or any other paperwork at all.

What is the parking event date for the one awaiting a POPLA decision? Do you think it is likely to be this ticket that is being chased by the debt collectors?

Normally PE pursue their own tickets via the small claims court, and they do it very quickly and in massive numbers (30,000 last year) after the appeals periods have elapsed.

But there are some tickets farmed out to debt collectors where (we believe) they don't have the landholder's authority to pursue to court stage. Yours might be one of these.

Where did the 'offence' take place (name of retailer, for example)? Was it Aldi - no Aldi cases, as far as we are aware, have proceeded to a court stage.

Debt collectors have one interest only, taking money off you, being helpful to you does not help them in their greedy quest in the slightest.
But if this went to court you have evidence you tried to sort it out, but were thwarted by these scammers.
I would leave it and see what happens next, you will get more scrap paper from Debt collectors though, but the thing to be wary of is real court papers, which will not come from debt collectors.

I checked the dates for the one awaiting appeal it is in the same April but not the same date and also that awaiting appeal has now got a named driver which PE had written to and that's why it is on appeal so it is no longer in my name

As far as the deb collectors letters, you can safely ignore them. Post 4 of the NEWBIES thread explains why it is safe to do so.
You have been reasonable and asked for information that they have refused to give. Debt collectors can't take you to court so unless you get anything from parking lie or the landowner you can safely do nothing, or complain to the BPA if you wish and then wait for them to sort it out.
Don't contact parking lie about this.

I wouldn't worry about that one then if you've named the driver and PE have issued papers to him/her.

Did the debt collector letter have a ParkingEye PCN reference number? If so, you might be able to ascertain more information about the charge via the PE website. Go as if to pay the charge by inputting your details and see what comes up. Don't go inputting any credit card numbers!

Thanks I would go the PE website and check later
    Thanks
  • I checked PE website and put the reference no on the letter and it said to pay £135.
This parking charge was dated April 2014, I don't remember receiving this ticket or any reminders.
The ticket was issued in a shopping centre parking space and the 2 tickets I have are for dec 2014 and jan 2015,
    What should I do

There's nothing you can do so late in the day other than see if there is any further move by ParkingEye. The debt collector letters are just aggravation factors - just ignore them.

Should PE come chasing you, you could then try to get the retail park landowners to cancel; you could try now, but that may just poke a stick in the PE hornets' nest, so, in my view, leave well alone. Other regulars might want to comment on this strategy.

I don't really understand how many tickets you are actually dealing with here.

    1. Which, if any of those described in your last post, is the one where you have nominated the driver?
    2. Is it £135 that the debt collectors are chasing?
    3. Have you tried inputting the details of the Dec 2014 and Jan 2015 tickets into the PE website? What does it say about those?

The bottom line in all of this is that PE are so quick to litigate, but with almost 12 months gone, it looks like they might not have the authority to do so.

You haven't changed address recently have you?

I have 2 tickets from this same shopping centre , one was approved on popla appeal, (dec 2014) and the other is currently on popla appeal with the named driver(jan2015)
So I was surprised to receive this debt collectors letter for a ticket of April 2014.
I would put the ref no and see what happens and I would post back
