CMC & Barclaycard question

Hi,
Just looking for a bit of advice.

Back in 2011 my wife & I pursued some PPI claims ourselves. We were successful with a couple & not so with some others. One of the unsuccessful claims was with Braclaycard. A couple of years ago a CMC got in contact with us & asked us if they could pursue. We just went with it as we were unsuccessful. They again came back to us & said that they were unsuccessful with the claim & that was that. Again about 6 months ago they got in contact about a couple of other accounts & my wife filled out the forms as we would never have bothered doing it ourselves & I believe they are still pursuing these claims.

Now, yesterday we received a letter from Barclaycard saying that they had reviewed our original claim in 2011 & have now decided that they were wrong & we should have received a refund. There was no mention of any recent claim. My question is, are we still within a contract with the CMC & would we still have to pay them a fee?

    Interesting, you would never have bothered doing it yourselves but as the CMC got involved, you did all the paperwork and thus all the work, sent it off to the CMC for them to post off? So you could be bothered to send the forms to the CMC instead of to the bank and lose 25-40% of any refund for the price of a stamp? Wow you must be rich to be able to waste that much money!

    You put in the complaint originally. If the CMC was stupid enough to try and put the same complaint in, they would have been told the complaint was already rejected and out of time to refer to the FOS. Your complaint was done by you so the CMC should not be entitled to anything as their complaint was rejected as duplicated (I'm surprised they didn't bill you for that if you had already put in a complaint and been rejected). Expect a bill from the CMC anyway though if they find out.

    Normally yes. You involved a CMC in the process and whilst the CMC do nothing more than post a letter to the free of charge complaints process address you would have used, that is enough for them to show that they are involved. Plus, the contract you signed with them.

  • If you look at this thread, you will see that this is probably not the case.

    I have put a link there to a bulletin issued by the claims regulator which explains why. If the CMC does attempt to charge you, I suggest you issue a complaint to the CMC with a copy of the bulletin. This can be done electronically if you have an e-mail address.

    If the response is not satisfactory you can go to the Legal Ombudsman free.
