This is a myth, they are under no legal requirement to volunteer that information, it is down to the buyer to ask and at that point they must be honest.

You're mixing a trader up with a private individual.

You must be joking if
a- you think you can get a full refund effectively
b- you think the dealer will give you anything

They'll just claim they told you and you have to prove otherwise.

You basically own a banger and havng this marker affects its value very little. How you'd prove any loss of value is beyond me anyway as the banger market can be fickle
