Unfortunately, they've sewn this one up as well.
Clause 32 of their T&C:
Every purchase you make shall be deemed performed in Jersey. Jersey law shall govern every aspect of contractual agreement concerning purchases made from the Site.0 -

It's surprising to me, as I was also unaware that Jersey isn't covered by the UK Sale of Goods Act. It wouldn't be immediately obvious to most people that Play.com are Jersey-based, and that Jersey doesn't have the same laws as the mainland UK.

Thanks DocN for pointing that out. I was half expecting the answer to be because they do not have a UK registered address, they can't be taken to a UK court but it would seem you agree to be bound by their local law at time of your purchase.
I presume this warning should apply to others such as Tesco Jersey as well then?
