  • Mr + Mrs gullible would just pay up at this point , in sunny suburbia , court is a stigma that cannot be mentioned at dinner parties
  • I am determined to fight this and am not the slightest bit deterred by having to defend my position in court.
I am just wanting advice on how best to deal with any potential court action from my current position.

As for Miah, keep hammering away at them, es[pecially their ridiculous charges, the more unanswered questions they have, the less likely they are to take you to court, and the more it will cost the PPC. Also keep the SRA in the loop, Miah must surely be bringing the profession into disrepute.

If you have done your research, you will be familiar with the name Ian Brill. Miah's association with Mr Brill does them no credit.
You never know how far you can go until you go too far.

There is little more you can do but highlight the fact that they have failed to answer your questions. In court you can ask the judge to request a response from them.
As said the more questions you ask them and the more they ignore you, the less chance Miah will proceed and will not turn up in court. Therefore you ask the judge to rule in your favour and for costs.
Miah will be acting on behalf of the PPC, so it will be the PPC that the judge will rule against.
If this happens, the PPC will get a judgement against them with instructions to pay you. If they fail to pay, at a small charge from the court, you can instruct bailiffs to call upon the PPC either for payment or to seize goods.

This happened to a Natwest branch whereby, they never turned up in court, the bailiffs were sent in to collect money or seize goods. The bank paid up within an hour.

The banks really thought they were above the law, The PPC's have this frame of mind as well. PPC's will get their wings clipped

I'm not sure if it has been mentioned already, but the Parking-Prankster does a guide to court for a few quid. I am led to believe it is well worth the money.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You acknowledge the claim within 14 days, not putting anything about your defence at first. That gives you another 14 days to submit your defence, which you must do.

I just typed 'UKCPS defence' into Google and you get umpteen good threads from pepipoo forum and/or here to show you the sort of thing to include and how to set it out. Bullet points at this stage. It will also be worth you posting on pepipoo forum for help with your defence, once you've safely acknowledged the claim and got yourself an extra 14 days.

  • I believe I may now have managed to trace the landowner. Is it too late a stage to approach them to ask to have the PCN cancelled?

You have nothing to lose by appealing to the landowner and everything to gain.

  • I am aware of Mr Brill and his activities. But is that something which can be brought into the court in this matter?
