Parking Charge on 17 October for over-staying by 31 minutes on an extra parking ticket purchased due to traffic delay en-route back to collect my car. Parking Charge Notice issued on 5/11/15 for £100.00 discounted to £60.00 if paid within 14 days. I did appeal and put forward the reason why I was late but this has been 'unsuccessful' in their terms but as a gesture of goodwill they have extended the discount period for a further 14 days from 12 Nov 15 and advised about POPLA, although state that if this is also unsuccessful I will not be able to pay the discounted amount in settlement but will owe the full amount.
Having read through various older threads I note that mostly advice has been to ignore these, however, from the Parking Cowboys website, I note that as of 4th Nov 2015, there has been advice of a recent law passed: The case, ParkingEye versus Beavis, was important in that it provided clarity on the legal basis for private parking charges.
Your kind advice with how to proceed would be much appreciated as I'm hoping I don't need to pay this fine. I felt I had been an honest and law abiding citizen by paying for an additional 4 hours on top of the 2 allowed and the total 6 hours should have been way more than enough to cover my planned route if I had not got caught in a traffic jam. The other alternative purchase was for 24 hours, which I obviously didn't need, so the choice I made was relevant to the options provided. My argument is, you can't just pop back and add another 4 hours when you are stuck miles away in a motorway traffic jam.

This is not a fine" , despite what you have said , its a pcn , a private INVOICE
the laws changed 3 years ago with POFA2012 so its also that aspect too
foirget older threads, read the NEWBIES sticky thread near the top of this forum and appeal it using the same options therein
then take it to popla if its a BPA member
meanwhile , complain to the services company and insist on a cancellation
so appeal , plus complain, are the first 2 stages , not naming the driver and not inferring who was driving either
so there is only one thread you need to read at this moment in time, the NEWBIES sticky thread , specially written for "newbies" like yourself to this topic
this is a civil case, not a criminal case , so its not about being a "law abiding citizen! (which Barry Beavis was too" , its about a honeytrap designed to profit from peoples mistakes or fallibilities
look at that popla section post and draft up a popla appeal in a similar manner , depending on who the PPC is , mainly based on legal arguments , not mitigation0 -

Beavis has very little relevance to overstays in MSEs, there is no commercial justification in deterring people from overstaying, indeed, if you pay the appropriate fee £10-12 every 24 hours you can stay for years.
I cannot recall a case where a judge has found for a PPC in a short overstay claim, but there may be one or two.
Do the PoPLA appeal on the usual, signage, contract, losses etc., pointing out in terms how your case differs from Beavis.t.You never know how far you can go until you go too far.0 -

Phoned Keele and spoke to a Finance Manager who checked with WH Smith who issue the parking tickets. Only 2 options, 4 hours paid plus the 2 hours free = 6 hours or 24 hours and no grace period apparently.0 -
a car park that is run by a member of the BPA (was it parking eye?)not allowing a grace period ,
please send them an email , asking again , and saying "is there a grace period"
await there reply , either they get it cancelled due to the grace period , or there email is forwarded to the BPA , who will not be happy
do not bother saying the overstay time to either Keele or the BPA , its the fact that they are saying one does not exist that will cause them problems0 -

I have emailed Keele direct and also explained further about another thing I forgot until now. There was a tyre pressure measurement team in the car park who stopped me to explain what they were doing and then I ran through their checks. I presume that the Parking Eye 'time clock' would have been done after this as well, further adding to my probably not very over-run time. Will see what comes back before I get more assertive.0 -
With a HUGE sigh of relief I'm just letting you know that I had a reply this afternoon to my email of yesterday to Keele Services and a very kind lady there has cancelled my PCN.

You need to be sure you receive written confirmation of the cancellation from ParkingEye. They are normally quite efficient at confirming cancellations by letter.
But sometimes things slip - especially by the person who said they would get it cancelled, who suddenly gets a few things across their desk - and then forgets to contact PE.
If PE don't get a communication from the service area they will process you as an 'ignorer' - and you're on your way to getting court papers.
All of this probably won't happen, but you do need to keep your wits about you and don't sleepwalk into court papers believing that all is now well. You wouldn't be the first!
