Novablack you really need to check your facts before posting, this is the third thread today where you have got your information wrong.best bet is to go officially and complain... and i mean trading standards.. http://www.tradingstandards.gov.uk/links/links.cfm
Trading Standards will not deal with a complaint that has not been addressed with the retailer first.you are FULLY WITHIN YOUR RIGHTS to return any product you buy during the initial cooling off period. this is given to you by statute, and no retailer can argue this. (and i think its 30 days but NOT 100% certain it could be slightly less)
It is seven days under the Distance Selling Regulations, and it does not cover all goods (though the OP's situation would be covered).Offences
If the seller is in business (rather than a private seller), he may have committed a criminal offence if he:
- gives a false description to the services he is providing e.g. falsely claiming to be a member of a trade association;
- advertises a misleading price;
With regards to the false description, Littlewoods made a mistake, they did not intentionally mislead the OP in their offer of Buy Now Pay Later.
I can't see anywhere where they misled the OP on the price of the good.
Please check your facts before posting.
OP, I'm pleased you got the problem sorted. Good to see that a common sense attitude worked! xGone ... or have I?0 -
err.. havent they said it would cost him £300 in may 2008.... sounds different to £300 now to me...
in terms of 'false description of a service' i really cant see how this could be any more clear cut.
and like i said in every post i wasnt sure of the time period and said so. my apologies it is not 30 days. (hence i said and i think its 30 days but NOT 100% certain it could be slightly less). i hoped to give a general overview that some1 else could fill in the blanks, i was trying to state there was a cooling off period allowed by statute. which ther is. however i did not have the name and now do (Distance Selling Regulations).
which you have, and i appreciate.
also apologies about the trading standards part. i assumed as he HAD contacted littlewoods and had been told he had to pay that this would be classed as addressing the complaint to the retailer.
oh and lets not forget that it was an overview. my most highlighted piece of advice was to use their returns policy, and i informed the OP of that. which he has now done.
sorry for innaccuracies. only tryin to help. i had posted all 3 responses (across the forum) before i read a reply correcting me and from now on i know the correct legal position.0 -
Thanks NovaBlack, you helped a great deal.
As for the making a mistake/misleading me, I did call to confirm twice, once with a manager that I wouldn't pay until May 2008. The second time I did this, I know for a fact that he was looking at my details and he paused, put me on hold, paused again for a full minute and said 'uh, yeah that's fine'.
Both of these times were after I'd been charged but before I knew about it.
Is there anything I can do with my bank to stop them charging me again and again, since this money was taken out of my account without my knowledge or authorisation?0 -
What sort of account do you have with Littlewoods? A credit account or cash account?
If you have a cash account, your not entitled to BNPL.0 -
Fourth post.
They've admitted fault and are refunding the console, just gotta get my bank charges back.0 -

You will find that it didIs there anything I can do with my bank to stop them charging me again and again, since this money was taken out of my account without my knowledge or authorisation?
If you have a cash account you will need to ask them to remove card details. If you have a credit account, they shouldnt have any details stored for you.0 -
'remove card details'?
We are talking about my bank, right?0 -
