DVLA flawed System

I was given a motor vehicle by my son, I registered it in my name and parked it on private land awaiting repair, I attempted to put it on SORN online but it said that the vehicle was taxed until 01st Jan 2016 so I left it at that, next thing i have a fine through door for failure to insure, but the law states that a vehicle does not have to be insured if it is not used on a public road, and it is put on SORN, So I wrote to the DVLA and explained that I could not put it on SORN as it is taxed, they have made date mistakes on my sons and my V5s also, how do I stand on this regards, Don

Sounds like the flaw is at your end. You made the decision not to continue SORNing the vehicle and then neglected to insure it.

Correct, both conditions have to apply all the time, due to the Continuous Insurance Law.

    SORN cancels tax.
It actually isn't taxed from the instant that you became the keeper, as a change of keeper also cancels tax.

You are bang to rights unfortunately, also you can expect a fine for not taxing it from the date you became the keeper.

Get it declared SORN straight away.
I want to go back to The Olden Days, when every single thing that I can think of was better.....

Yes, your error was in believing that it was still taxed after change of oner, since 1st October 2014 that always cancels VED and the new owner is then immediately responsible for either paying for a new period of VED or putting the vehicle on SORN. The online system is still a bit dodgy (it does explicitly state that it's a Beta system) so to be certain you need to ring DVLA.

Indeed, albeit THIS one was the first to get any replies. :)

When the car was registered in your name, that cancelled the existing tax, and the previous keeper would have had a refund. This has been in place for over a year now. You could have SORNed it immediately using the document reference on the V5C/2 New Keeper slip.
It has been an offence since 1998 to have a car that isn't taxed or SORNed.
It has been an offence since 2011 to have a taxed but uninsured car.
