Advice please re claims guys

Options
Hi
I am just wanting a bit of advice please. We have filled forms in with the claims guys and after reading all the posts on here I wish we hadn't . We are now out of our cooling off period and have received a txt last week to say that they are sending out further paperwork regarding ppi that we paid with Nat west. We don't want to stay with them now and realise very stupidly we have made a mistake and will have to pay fees to leave. Please can anyone advise what steps I need to take now. I was going to phone them on Monday and tell them we had decided not to go ahead with them but is this the right course to take?
Many thanks...and I know we should not have used them in the first place.Just wish I had read these boards before ...cant believe we were sooo stupid!!!

Did you sign the first papers to let them put claims in for possible mis sell PPI?.

If you did, WRITE them a letter ( MAKE A COPY) and tell them you no longer require their services, ask for a full itemised breakdown of the charge for cancellation.

If you can cancel, make sure you get it in writing first from them before you do the claims yourself.

    Hi
Thanks for the reply. Yes we have signed the initial papers but that's all. They are sending out further papers to sign to go ahead with the Nat west claim but we haven't received them yet. I honestly don't know why I didn't look on here first. I was wondering if you have any idea as to how much they may charge us as a cancellation fee? It says in the small print you can obviously cancel after the cooling off period however there will be an admin charge based on the work they have done. Thanks

Do what I said about getting a full breakdown of the cost of cancellation when you no longer want their service, put it in writing.
Let me know what they will charge for posting paperwork to you!.

If you do not think it warrants the charge, it won't, you can go to the MOJ and make a complaint.https://www.gov.uk/complain-about-claims-company

Make sure you keep everything in writing and do not do the claim yourself until you have a letter stating you have cancelled with them.

    Hi
Thanks again for your reply:) Shall I just write to them cancelling rather than a phone call...or a phone call then write the letter? I will do exactly as you have said....many thanks. Do I need to give a reason as to why we are cancelling or just keep it very simple? Thanks

You can telephone but do it in writing too, just tell them you do not want to proceed.
Don't take any crap, if they get clever, tell them you will make a complaint to the Claims Management Regulator.

No I wont be signing anymore papers. I just wish I had had a look on here re ppi before we signed the first lot. I will phone them Monday and tell them we aren't going ahead and I will be putting it in writing. Many thanks again for taking time to reply.

It would need to go to the Legal Ombudsman.

It is worth looking at the Conduct of Authorised Persons Rules 2014, first to see if any of the rules have been broken.

The most likely one is Client Specific Rule 10, which says, "Before seeking to enter into a contract with a client a business must make reasonable enquiries
as to whether the client has alternative mechanisms for pursuing a claim and must advise the client unambiguously of ombudsman schemes or other official means of redress."

If they did not unambiguously inform you that FOS was available, free and has guidance on how to complain free of charge on its website, that rule would seem to have been broken.

Looking at its website, there does not seem to be any such notice, although they may have done so by telephone.

    Hi
Just an update. I telephoned them yesterday and said that I wished to terminate my agreement with them. The lady I spoke to said that I needed to put that in an email to them. I then got one of those replies that said I can expect a reply within three days. I am waiting now to see what they have to say. Thanks again for the help. I stated about three times in the email that I wished to terminate my agreement with themselves...I stated that we had only just signed the first papers but we had decided to not continue and wished to terminate our agreement with themselves.
