Help! salary not paid

  • Thank you for the responses guys.

Unfortunetly I have still not been paid. My employer is claiming that my wages left their account yet my bank is claiming nothing is on their system. What are my options now? can my employer really dismiss this issue by claiming there is nothing more they can do? do they not have a right to trace? unless tracing meant what they said about confirming my salary left their account. I also re-confirmed a few times already if they have the correct bank details, then again someone in their payroll could have accidentally in putted a wrong digit/number? or is it a case where it is automatically set up i.e. account number and sort code rather then manually inputting it to process payment?

What rights do I have now? I really do not want to threaten with legal actions but surely 4 days late is cause for concern? I have emailed my bank statements showing no wages have come in, which they requested. All they tell me is that we have confirmed it left out bank, yet my bank which is Nationwide claiming nothing is appearing on their system...Wages were meant to be sent on Friday 13th November, I also have a pay slip but that does not show bank details or hours worked...

Any advice and opinions are welcome please.

    your company is lying.

Is it an official payslip with tax details, e.t.c? or something they typed up?

They need to prove they paid xxx amount to xxx account. You need to go back to them. they sound to be fobbing you off and 6 weeks full time wages is a lot to just 'leave for now'. If they messed up, they need to just fix it for the next cycle, as sometimes new payee setups are forgotten/missed.

Give it a full week and then ask Nationwide for written confirmation that nothing has been received.

Go back to your boss (or hr) with said letter and explain your financial difficulties that you're experiencing with no salary payment and you need an immediate advance until they fix it.

If it's their funds missing, they'll have more incentive to fix it.

    See

    https://www.citizensadvice.org.uk/Documents/Advice%20factsheets/Employment/e-employer-withholds-your-pay.pdf

    Note in particular

"Make sure you have a detailed (itemised) pay slip which lists how your pay has been made up and what deductions have been made. You have the right to an itemised pay slip so you should ask for one if you have not already been given it."

You said that other employees received payment into their bank accounts on Friday but you also mention
Wages were meant to be sent on Friday 13th November

If the money has not reached your account by tomorrow, advise the payroll clerk immediately since he/she will need to request the company's bankers to trace the payment.

And follow the advice in the link.

I wouldn't automatically say the company is lying. They may have made the payment but the bank account may be wrong. They need to provide proof of the exact account/sort code it was sent to. As it's the first payment it's entirely possible that there is an error in the digits.
Remember the saying: if it looks too good to be true it almost certainly is.
