  • If you want an exact fit you're gong to have to pay for custom made or find someone selling the exact size. However any inconsistencies in the brick work will either show up or they'll not fit.

    Send them back as no doubt this was a distant sale.
  • spoke to CAB and they said I can reject goods according to 2015 consumer rights act if they don't meet their description, passed this onto the seller and he said they do meet the description!! And that we signed for them anyway when the driver delivered them. I argued that was for receipt of the product only.

    His response was that a signature from the driver (from me) also meant that we had checked the products and they were correct.

    CAB asked me to send them a recorded letter along with the invoice and if they still don't agree the it will go through arbitration and then the small courts.

    I told the seller that I don't have time and that I'll accept the £120 and they can collect the railings.

    I just thought I'd update this thread to let people know in case they have a similar experience. thanks for all your help.

    As you have accepted their offer, there is not much point in saying any more, but as you said, for the sake of others...

    Signing on delivery is not signing that the goods conform to contract. The Consumer Rights Act specifically allows a consumer up to thirty days to satisfy himself that the goods conform to contract.

    Hi

    I bought some gates and railing from a company called cannock gates, the products are flimsy. I hired a builder to help fit the gates (he charged £50).

    When it was time to fit the railings they were short by 3inch, I contacted the company and they replied that they are made like that to allow for the fittings. Now the fittings are really poor and are like a t-shape (1/2 inch width if the product screws all the way down the centre thread) with a long thread to allow for a nut. So even if we were to fit the railings against the brick they would not be flush with the wall.

    I contacted the company and they argued the 3inch gap rule is in their terms and conditions and on their how to measure page. But I couldn't see it and they ignored my request for them to point it out specifically. They then offered a goodwill gesture of £120, when in fact it should be £160.

    Should I take it and just leave it like that and avoid the fuss or do you think I should do a chargeback for the amount (paid with visa card)?

    May I inquire as to how the following may affect your situation?

    We allow 2” (5cm) ground clearance for all heights of steel gates and railings. Therefore a gate listed as 6’ (1.83m) high will measure 5’10” (1.78m) high when delivered and 6’ (1.83m) high when hung.


    All heights quoted allow 2” (5cm) ground clearance.

    Does this, or any of the other information contained on this bit, have any bearing on your case?

    It has no bearing on my case as they are talking about the height and not the width.

    I'm tempted to call them up and cancel the collection and go ahead with trying to get back the £164

    True, many years ago when i signed for things, i would also write goods unchecked or count unchecked
