PCN from parking eye - initial appeal

Dear all
I overstayed by almost an hour in a car park of shopping outlet managed by PE. They have sent a fine of 50£ if paid before 12th November or 85£ in 28 days. I was genuinely shopping in the shops there all that time and I have 4 different store receipts from that retail park to prove this. Reading through the posts what I understand is parking eye will most likely reject the appeal even if I had shopped there. I was thinking of using this template below from the stickies thread to make the appeal. Should I also mention about taking things directly to the retailer. The shops were all madly busy that day.
Would greatly appreciate some help.

I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park.

There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

The driver was a genuine patron of the retail park and has receipts to prove that the driver was shopping at the retail park which has been attached with this appeal. The receipts cover from the time of the vehicle entering the premises till the exit. The time period specified covers lunch time and therefore the driver had to have his lunch at Subway in the retail park which also adds to the time.

I have kept proof of submission of this appeal and look forward to your reply.

    You appeal to both PE and the landowner/retailer in tandem.

    PE might cancel but the retailers usually will be far more obliging.

    Keeping to timescales is very important.

    If it's a retail park check for advertisement consent with the local planners.

    What location as most sites have history which can be useful in appealing?

    also add a note saying an occupant of the vehicle was a genuine shopper and attach COPIES of the receipts etc (scans or digital pictures)

    do not mention who was driving, no admissions at all

    if presented with evidence that shows proof of patronage , they do often cancel the charge (its a charge not a fine , you made that word up yourself)

    I doubt that a retailer will help, because if there are several shops it will be on a retail park, probably owned by a third party (its the landowner you should be complaining to)
  • Thanks for the replies. It is the Bradford Forster square retail park. The retail park website has a contact us form which doesn't have option to attach pics of receipts.
    Should I complain using that or is it better to complain by post to the retail park with copies of receipts. There is an email id for lost property on their faq page. DCopeland@savills.com
    Is it better to email to that id which sounds like an estate agent/property management service.
    Is it ok to give the details of the driver to retail park. Any templates for complaining to the land owner / retailer.
    Is it ok to say the occupants were shopping at the retail park or better to specify that the driver was shopping.

  • As with most Savills sites it is probable that they are in on the financial rewards game.

    Look up the threads for this Bradford site. It has form. Complaining to Savills can help with a veiled threat of bad publicity in the run up to Christmas. Copies of receipts are essential and you will stand a good chance of cancellation. The same applies to your PE appeal.

    Don't dilly dally, timescales are important with these appeals. Getting the POPLA cade from PE is what you need so don't miss out through hopes that Savills will help you out.

    If you've spent a fair amount (£30 does it at Aldi/PE car parks) then I'd be very surprised if PE don't cancel.

    Despite being one of the most rapacious PPCs out there, they are better than most at dealing sensibly with genuine, with proof, on-site spenders.

    Get those COPIES of receipts off to them with your initial appeal.

    Personally, I would write a strong letter of complaint to each and every retail outlet in the complex, even those you did not patronise this time, threatening that you and your family will boycott the complex unless PE cancels.


    If I want to spent several hours browsing in the 25 shops in this mall I do not want some parking company tell me I can only spend 6-7 minutes in each, especially the restaurant.
    You never know how far you can go until you go too far.

    Spent roughly 30 each in Argos, Home bargains and sports direct and some minor purchases in ASDA. Got the receipts with timings to prove it. This doesn't include the time spent in restaurant and browsing other shops. Could PE still reject the appeal saying that even if you are shopping you are allowed only 3 hours to shop?

    They could do, of course. This is a largely unregulated skimdustry you are dealing with. Expect anything - including a cancellation if you send COPIES of those receipts.

    Explain to ths stores that you don't wish to keep what you've bought given they've fined you for being a good customer.

    You now get a 'fine' after 1.5 hours, half the time! Include that in your complaint and tell Savills you are now not able to shop there. Imagine trying to comply at Christmas and in the new year sales!

    Nice move, ParkingEye, why do retail parks fall for this harassment of their customers and believe the PE reports along the lines: 'reducing parking times increases footfall' ( = increasing revenue for PE). Utter rubbish about increasing footfall.
