    Thank ollie300 i replied before you had finished your answer :think: well anyway, i am a bit worried to go to the court as i don`t if i have a case. I am very angry about all of that as i really thought we had done a good job for giving the property back in a reasonnable good state. I am so angry with the quote of the carpet, the coffee table and the armchair. I am just chokcked with the keys and the chairs !!! that is so unfair

    Well i am preparing the letter before action. Would you mind if i post it in here before sending so you can help to correct my english ?

    Your landlady is having a laugh! :mad:

    From what you say she is trying to charge you over £3,500 after moving out. I doubt if your deposit was even £1,000 (how much was it?)

    These are typical "scare" tactics to try and get you to forget about getting your deposit back. I strongly suggest that you issue a county court claim for the return of your deposit (a district judge will soon see that your LL is trying it on). If you are worried about this then contact your local branch of "SHELTER" (www.shelter.org.uk) who will give you free housing legal advice and may even take on your case and take your LL to court for you.

    Of course this all depends on what you have said on this forum being true. If it all is, then you are more then justified in going to court. Landlords retaining deposits (which tenants usually need to move-on) makes my blood boil !!!

    Your LL is an "Ars#hole" and needs to be brought to book! :mad: :mad: :mad:

    thank you coal9011. I just feel very upset now but i don`t want to let it go. What i have said is true : state was not perfect when we left but we were completely ready to discuss it (dining area, cleaning of the armchair + an other cleaning of the house as i said on my first post, i was not happy with the maid cleaning) but now i just don`t want to negociate anymore as these quotes make me crazy !

    What do you think about the furnitures dilapidation she is trying to charge us ? is that fair ? or wear and tear ?

  • No way is this fair.

    Even if the furniture was "brand new" when you moved in then the LL would have to make an allowance for ware-and-tear and reduce her estimate. I think that you really need to get before a judge - it's suprising how fair to tenants judges are. They see bad landlords before them every day. Get on the telephone to your local Shelter office tomorrow! ....Good Luck!!!!

    How much is the deposit?

    We have been here before:

    PS If you have a spare 24 hours you could read it as a detective story or alternatively read the first dozen pages, write down what you think should happen and then flip to the end; but that spoils the suspense!

    well with 3 young kids, 24 hours to spare is sort of a dream :D

    I will read it tonight with interest, thank you.

    The deposit was of 2100 pounds in London (i know it is huge but she request it as we were just arriving from abroard and as you may have guess from my poor english, we are not british but french) for a 2 bedrooms garden flat in fulham. We have now left london behind us to buy a house near canterbury where it is much more affordable and my husband commute to london every day.

    So she is requesting more than 1400 pounds on top of the deposit. I just spoke with the Estate agent on the phone and she was also quite surprised by the landlady list and advised me to reply in writing and mention my intention to go to court if necessary. The deposit is in the hands of the agent but before they give it to any of us, we need to reach an agreement or have a court decision.

    Well now i guess i need to go and cook a nice super for the kids as they keep asking me to stop "working" on the computer and feed them :D

    boeuf aux carottes tonight, I hope my neighbours liked the smell.

    One thing i appreciate in my new house is the lovely neighbourough we have. Everyone is willing to help and advise the little french family :smileyhea. Life is so nicer in here, i wonder why we want to london in the first place :think: silly us :rotfl:

    OMG, I would go fricking crazy if this LL was trying this on with me. Who the hell does she think she is!!!! I totally think she is taking advantage of you being from france and not having the best english. She obviously thinks you will just pay up.

    Do not let her win. Got and see a solicitor for a 30 minute free consultation to see where you stand.

    Seriously cannot understand the cheek of these BTL morons.
