Energy Company incorrectly put defaults on my credit file

  • And the saga continues, they've upped their offer now by another £30 which brings us up to £105 to apparently cover my costs for having to join Experian and £75 'goodwill' gesture. I've advised them that this is still completely unacceptable so I await the Ombudsman's support now. I'm told that I can't expect to be compensated for the extensive amount of time I have had to invest to resolve this situation nor for the solicitor's fees and surveyor's fees that were incurred as a direct result of losing the mortgage due to the incorrect defaults. Does anyone know the legalities around this as I have a feeling that they are bluffing here?

    Work out all your losses and send them a notice before action stating that if they will not pay the value you calculate within 14 days then you will submit an N1 and begin court proceedings against them to recover all sums due to you.

    The cost of bringing a case to small claims is quite small and it is straightforward process. Would be interesting to see what their defence would be.

    Easy . Prove it.

    There's no certainty that a mortgage offer would have even been made.

    Without substantive evidence little point in wasting a court's time.
  • Actually, as soon as these marks have been removed the mortgage company have offered the full amount we asked for but the house has now sold to someone else so yes I can prove it.
