    In your opinion Guest101, am I better of starting the claim at the end of the fixed term or sooner? As she does not physically owe the money yet, only once I have paid the rent.

    She owes you the money as soon as it becomes owed, not once you pay.


    Your contract with your ex is:


    On the x'st/nd/rd/th of each Month you shall pay me £x for a period of Y months, expiring on the __/__/__.


    This is evidenced by payments made to me to date on the <list of payments>, these payments act as proof of your acceptance of the terms.

    Could try negotiating with her.

    1/2 the rent.
    1/2 the council tax.

    Since you're the only one that uses the power/water/internet you should offer to pay these.

    Get a lodger and get some income if allowed.

    That sounds reasonable. So currently she owes me for one months rent payment. If I go to court now will I be claiming one months rent payment not the future payments as they are not due yet?
