Trespass Boots Problem

HI
I need new waterproof boots for an event on November 7th. Found some I liked on-line by Trespass. I prefer to try on rather than order on line, so my friend took me to her local Trespass shop when I was visiting her.
I requested size 7 or 8 ladies boots and was supplied with several to try on. Selected a pair and paid £12.99 (much less than I had seen them on line for).
Worn them once and they have ripped my heels apart. Cleaning them for return and I notice that the box says size 7 (40) but the actual boot label says 6 (40). Not what I asked for in store.
I contacted the shop I got them from and they have no other boots in size 7 for sale below £80. If I travel to them they will refund the purchase cost but cannot supply me with a replacement pair.
I telephoned Trespass Head office to request a return and a replacement of the correct size which they have refused to do. The options they gave me were;
They will not accept returns of goods bought in stores, only on line.
Return boots to the shop where I bought them for a refund (nearly 1 1/2 hours there and back). This leaves me without boots.
Order the same boots on line from them, and pay extra for both the boots and postage. This also risks that the boots don't fit so I will be out of pocket. I would still have to travel to a physical shop so I can get a refund on the mis-labelled boots. They also cannot guarantee that an on-line order would get to me in time.
I have contacted all local Trespass shops within a 20 mile radius and cannot source another comparable pair of boots in the size I need. I have found a local supplier (Towsure) from whom I have purchased a comparable pair of Trespass boots which have cost me £24.99. They did have the same style as I originally bought, but not in the correct size.
Can I insist that Trespass offer me a no charge return as the boots are faulty (incorrectly labelled)?
Can I also reasonably ask for the difference in the cost of the new boots as I made it clear that I need them for a specific date and they cannot supply me in time?
I can return them to the original shop but it will probably be between six to eight weeks before I will be in that area again. That is too long to leave it isn't it?

However the boots might be labelled, surely the point of physically going to the shop to try them on is so you can check that they fit at the point of purchase?
I find walking boots vary in size so take a 4 in some brands and a 5 in others.
I think you're lucky they're offering to refund at all given that you tried them in store and decided they fitted well enough to buy.All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have, not could of.0 -
You tried boots on and deemed they fitted so I'm afraid I don't really see how the size on the boot has much bearing on this.0

EU 40 is a UK 7. It sounds like you were provided with what you asked for.0 -

She certainly got the box she asked for, but it appears that the wrong boots were in that box.
The OP told us:mossstitchmama wrote: »Cleaning them for return and I notice that the box says size 7 (40) but the actual boot label says 6 (40).
I too cannot understand why the OP didn't try on the actual boots she purchased.0 -

Ahhh, ok, so yo tried on a pair from the display, which fitted, so you bought them, but the pair they sent you home with were a different pair from the stock room that do not fit, and seem to have the wrong label on the boot?
As they are faulty (wrong label), then the are fair offering you a return for a refund. perhaps you could ask to return them to a nearer store instead?
You cannot then expect a replacement pair if they do not have that size.
You will just havr to purchase elsewhere.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
OP, did you buy from an outlet store?
Perhaps that's why you found such a good price.
A number of sellers will not allow purchases from outlet stores to be returned to 'regular' stores.0
