In the end, it's up to you.
40% discount is good, if you CCA'd them, and they didn't/couldn't comply, you still leave yourself open to hassle.
If you just want closure, then that's not a bad discount to be fair !!!I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Can I ask, With the route I am taking could I also be liable to a ccj ? I have never had one before.0

Technically they could start a court claim but you would apply to have it 'stayed' as they have not complied with your s77-9 CCA request.
You have an additional line of defence (s127) as it is a pre-April 2007 agreement.
So I doubt they would try it.0 -
Hi again,
The latest update is that some how first credit have managed to get hold of my mobile number (any idea how?) and sent a text message for me to contact them with a ref number.
Am i still doing the right thing ignoring them as they have not adhered to my CAA request?
Just after some reassurance really.
Many thanks to all.0 -
Ignore!!!
You are making the classic mistake of thinking that if you contact them you will get a reasonable person oin the other end who will listen to you and say 'youre right, until we comply with you CCA request we will put this on hold'. You wont. you will get some dimwit interested only in hassling you, they will not listen to you, they wont put any action on hold, they will almost certainly lie or at the very least stretch the truth.
ignore them.£1000 Emergency fund No90 £1000/1000

No matter what the status of the account, they will always want paying, and they will still attempt to get you to pay, that's how there business model works.
As I said before, the account is presently unenforceable, if, they were to start a court claim, you can have that stayed, as Fatbelly has said, because of there non compliance.
So as things stand, all your bases are covered.
You don't need to do anything.
You could, if you felt inclined, write and remind them of there obligations under sec 77/79 CCA, otherwise carry on as normal.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
