I still not heard a thing, how long to do you think is reasonable time to wait? I have not had any correspondence with them since 24th November.
Many thanks in advance
Well I would say that's probebly good news.
You are aware that as things stand right now, the account is unenforcable until they do reply to you.
The fact it's taking so long makes me think they can't produce it, however, that's just my thoughts.
Are you still paying this ?
If yes, it's up to you if you want to stop, the usual time frame is about two months for a reply, so you should hear something soon.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi there
Well the reason I am back is that I have finally heard from First Credit. I stopped February payment onward and this week received my first letter from them and its just a generic one.
It simply says "If we dont hear from you we can't help" along with a Financial statement (SAO) they want me to fill in and sign.
Want can I do now? They have not produced CAA and as it turns out I received some PPI from Abbey (Santander)and they had to guess this as no know documents are available.
Many thanks for your valuable advise in advance as usual :T0 -

It's not really your responsibility to follow this up, the ball is in there court.
The debt, currently, is unenforceable, and will remain so till they comply, however long that may be.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Sorry to Hijack your thread but my question is simple and aimed at Socrates as you prob remember you have help me get one debt from lowell SB and another possibly SB I now have 3 outstanding accounts I was going to settle as partial payment non are pre 2007 would you do a CCA as a formality rather than decide to pay these without them proving they have the paperwork to make the debts enforceable?
Also if a CCJ has been obtained can I still go down the CCA route
If so could you provide the link to CCA requestsSealed Pot Challenge 10 - #5710 -

Hi,
You should always make a CCA request before making any settlement offers, it doesn't matter if the account was opened 10 years ago, or last week, if they can't provide proof a debt exists, in the form of a credit agreement, reconstituted or otherwise, then they cannot enforce there rights in court.
If an account is subject to a CCJ then that changes things, you can still make the request, but if the creditor was unable to comply, as they already have a court order, they can pursue you for it regardless.
