Northern parking services ticket claims on private property but their pics show not

Hello folks,
I know there has been alot of posts around this topic and i apologise if anyone thinks I am duplicating but I feel my situation is slightly different and really need some advise.

Sooo..... I parked along the street from Puregym newcastle this morning. I had parked with 1 wheel partly on the curb. When i came back I had a parking charge notice from Northern Parking Services claiming I had parked on private property. The building that was set back from the road did have a private parking nitice on it, but i was not parked in their car parking spaces, i was parked on the road which is owned by the council. I contacted Northern Parkibg Services straight away and they sent me the pictures they had of my car. I tried to upload tyem but unfortunately have noo idra how to do so on here.

Anyway, the pictures do not show AT ALL the wheel that was on the curb, it just shows 3 pics of my car parked on the road then a pic of the sign on the property.

I replied to the company stating this snd they replies saying "The pictures clearly show the vehicle being parked on private property obstructively". I replied saying please highlight or circle on the photos where the vehicle is touching private property. It is parked on the road which is owned by the council. I then got a reply to this that says

"Dear Mr Symm,
Without Prejudice, we have clearly informed you of our position. Your vehicle was parked clearly obstructing private property. We have given clear indication on the next process to follow and given our reasons why this appeal was refused. We shall no longer enter into any further dialogue regarding this appeal.
Regards
Appeals Team"

I will mention at this point that I am female so have no idea why they are calling me Mr Symm. I replied with......
Hello,
As obviously you have no proof that the vehicle was parked on private property, the pictures clearly show the vehicle parked on a PUBLIC road, therefor I will not be paying the ticket. You have been unable to clearly show my vehicle touching any part of the private property. Also no instruction to the bext step has been given and I will also be making a formal complaint regarding the sexual prejudice being used in your response when addressing it to 'Mr Symm'.

Thank you

Alex Symm

I have had no further response, can anyone advise whete I stand now?? I wish I could upload the photos to get everyones opinion on them

Thanks for any advise in advance :)

  • Find out if the road is council or private by speaking with the council.

If it is public highway, make a fraud report with the police.

host the pics on tinypic or photobucket and add dead links in your reply (change http to hxxp)

check the road status with the council

its an IPC member so you may have to go into IGNORE mode for 6 years, like the NEWBIES sticky thread advises
  • If it turns out to be council, what they are doing is fraud and a crime number kills any court claims stone dead.

In the dialogue box, before you hit the 'Post Quick Reply' button change http to hxxp, then hit the button. I think that should work.

you cannot add a live link, but you can add a dead link, follow the instructions I gave you earlier

if the road , kerb and pavement are all council owned, then a private company cannot ticket you
  • Sorry I missed that part.

Here is link to the pics :)

Can you give us a postcode for the gym or the street name where you parked so we can have a closer look at the area on Google Maps Street View please?
