arghhhhhh I'm in need of advice

    What's the actual problem here?

    Nobody's going to be buying your house. Nobody's even going to be viewing it.
    If they want to waste a highlight spot in their window... <shrug>

    The problem i have is, its misleading people that might want to view it, they are telling people "due to my personal problems" or as they said we shall make up a load of lies about you... also while they still advertise it, they are going to charge me for cost incurred for advertising, even though im not selling anymore.

    If that's what they say I'd definitely get a friend to phone asking for a viewing, note down what they say and issue a letter before action regarding slander (or libel if written) - they might just cough up some cash!


    As for charging you, what does the contract say?

    They can do what they like (within the contract) in the 28 days notice period. You're not selling and you're not allowing viewings so just leave it at that.

    EA's have lots of properties on their books which are never going to be sold. They do it to make themselves look busier than they are. There isn't much you can do about it until the 28 days are up.

    Anyway its all done now... have spoken to Ombudsman and they said what they are doing is wrong and they are calling them now to remove all my details from their branch and online ... other wise they will be going down the complaints procedure route... lets hope that has done it as my nerves are shot to bits.

    The contract said they "reserve the right" to charge .....

    Well ye, but reserve the right is meaningless.


    Fees need to be laid clearly out in the contract

    Glad you did that.

    Whilst it isn't the crime of the century, deliberately misleading people should be frowned upon. Surprising to see members of this forum saying to turn a blind eye to such action.
