Selling our house. Buyers solicitors questions!

We are a couple of weeks away from selling our house but the buyers solicitors have asked a few questions?
The house was a new build bought Dec 2005 so the house is nearly 10 years old
So they have asked for a building regulations approval/completion certificate for the property
We never had one of these so not sure what they are on about?
We have the NHBC certificate "Buildmark Cover" and that's it and a domestic electrical installation certificate.
They have asked for a copy of the "section 106 Agreement" dated 6th October 2003. Reading through we think this is the initial planning agreement between the builders and the council
Why would they need this?
They want us to confirm when the boiler was last serviced? Is this a legal requirement?
Hope anyone can help as were wondering if it will all fall through now.

First of all, are you doing your own conveyancing? Because it would be simpler if you left your solicitor to answer this stuff.The house was a new build bought Dec 2005 so the house is nearly 10 years old

It's the bit of paper confirming that the building control dept from the council inspected the house to confirm it had been built properly. Your solicitor should have got this and put it with your title deeds.They have asked for a copy of the "section 106 Agreement" dated 6th October 2003. We have a solicitor and this is the letter they have sent us today and we thought it was a bit strange to be asking us to confirm about section 106's and building regs?

They will be able to get all this from the Council searches - I wouldn't worry about it.0 -
That's assuming it was a council employed gas engineer who serviced the boiler....

Wow, your solicitor really should sort this out for you, I think this is conveyancing and that's what you pay them for.0

Unless you were the developer, it would be unlikely that you would have been given these documents and quite probable that when you purchased the property that your solicitor searched the local authority records.
Although he may have requested the documents if a private building inspector was used.
If you have an NHBC warranty then the developer would probably have used NHBC building control and either way NHBC would not have granted the warranty without building regs sign off.
I have developed a few properties and never supplied planning/building regs documents, other than the warranty and my solicitor has always referred the buyers solicitor to the relevant local authority records.
Why you would have or need any knowledge of the s106 obligations is beyond me, it is an agreement between the developer and the council as part of the negotiations leading up to granting planning permission. Most s106s don't even involve the developer doing anything other than handing over a load of cash to the local authority and usually these obligations have to be met before works commence.
Also a huge amount of s106 money is eventually reclaimed by developers as quite often local authorities fail to use this money within the legal timeframe. So there's a good chance that the solicitor wouldn't have anything to reference against anyway.0
