Sports Direct Fitness (gym) charged for extra month after cancellation - no refund

I'll try make this as easy to read as possible.

So joined sports direct fitness (gym) over summer, direct debit and no contract with leaving a month to cancel.

Cancelled approx 22nd august - the way you cancel is writing a cancellation form in-gym (a simple form saying why you cancelled etc). They said that was fine and it would be processed. Now September 1st should have been the last date i was billed.

But october 1st i got billed yet again for another month of usage. I rang them up and after much back and forth, determined
-my account seemed to be mixed up on the system with a previous membership i had a year ago
-there was apparently no record of the cancellation form
-they have now cancelled my membership (after october 1st).

i have spoken to the manager of my gym several times now, this process lasting 3 weeks and she claims to have gone through all the paperwork in august and couldn't find my cancellation form. I know that I genuinely did it, so I am livid! They say there is no proof that i even cancelled the membership. As a student, it literally feels like someone has robbed from my bank account. What's worse is that since i've gone to uni i can't even use the gym membership.

The gym manager claims there is nothing they can do and no refund can be given. What shall I do? Should i go to a higher authority of sports direct, seek help, what is the right move here?

  • oddly enough i went to my local dw sports to enquire about cancelling my membership, i broke my elbow and no longer able to use all the equipment, they told me i had to ring their cancellation team. on the other hand my son cancelled his membership last year in the gym without any hassle at all.
    if i have to do a form i will make sure i photograph the bleeding thing at the gym itself :)

    hope you get it sorted, first thing i would do is now cancel the direct debit so they cannot take anymore and personally i would just give them the finger and put it down to experience.

    Without evidence that you cancelled such as proof of postage, you probably won't get very far.

    If it ended up in court you'd lose. Better to just pay it to avoid future hassle.

    Just show them the receipt you got when you handed in the cancellation form.

    If that's not possible, then follow boo_star's advice.
  • i have been told to pay an extra 3 months subscriptions for cancelling the contract which was not explained on the date of joining, looks like they just want to charge members more money.....daylight robbery, even though i mentioned that i was moving to a new location which is 'more than 10miles of their radius' ....and will have to pay another £10 for cancelling the contract despite having used the gym for more than 6 months.

    What does your contract say?
    Is there a minimum period specified?
