Parking in housing estate

Beevorma
Hi Folks,
I could really use your kind advice as i'm slightly confused on my position and next steps.
On Friday i popped into my local town (Daventry) and as all the car parks were full, i parked in a space belonging to some private apartments which are always empty during the day and right next to town. Parking is usually free in Daventry.
The area where i parked is well sign posted, but i didn't read them as i'd parked here a few times without issue before and after the signs went up
From when i left my car, picked up my suit from the dry cleaners and got back to my car 6 minutes had passed and I had a PCN from a private company called "Northamptonshire Parking Management Ltd" on my windscreen advising i needed to pay £100 or £60 within 14 days.
Whilst i accept there is a liability on my part, i think £100 or even £60 is an outrageous amount of money for 6 minutes of parking (especially as we are expecting our 2nd and £ is a bit tight). I've read various posts where people advise to wait 56 days to see if the NTK comes and where some have just sent off the template letter stating "The charge is disproportionate and not commercially justifiable."
Any advice please on how i should proceed?
Many Thanks
Martin

suggestions:
edit your posting to read "the driver did,,," not "I did"
if you do get into communication with them , always say "the driver ,,, " and don't drop yourself in it0 -
Hi Freddy,
Thanks for the info, I am aware of the "i wasn't the driver but the keeper stuff" and i've read most of the info, the bit i'm not certain on is the fact that i don't really have a proof of patronage in that i've just parked in a non pay and display area? Am i still right to claim that it's an exorbitant amount?
Hi Eman,
Read the sticky re sending the letter off on 20 days thanks, I suppose once I've sent that i'll get all the letters to my home address but hey-ho. Does the 56 day rule change if my car is a company car? As i believe if you get a speeding fine it takes longer to get your personal details so the 14 day rule doesn't count?
Cheers0 -
with a company car , there may be some problems , does your company tax the cars (ie have they got the V5s) , you are not the driver or registered keeper , you are just the "keeper"
if its thru a lease firm , do they charge you for paperwork , or are they know to pay "fines" and pass the bill on?
from the "stickies"
* COMPANY, LEASE OR HIRE CARS ANYWHERE IN THE UK
In the case of a company car or hire car, the above advice differs if you get a windscreen ticket. You would have to appeal EARLY to hook the PPC in your direction, before they get a chance to get the keeper's details from the DVLA. You should also warn the owner/keeper (Fleet Manager) not to pay if they do get a letter about it because they have no business to get involved in a fake PCN you have already appealed as driver, and you won't reimburse them if they are daft enough to pay it.
If the hire/lease co gets a postal PCN and names you as the driver/hirer, that is a good thing as it removes them from the loop entirely and then you can follow the above advice as appropriate to your case - but check and see if they have charged an admin fee. Challenge that admin fee with the Fleet Manager, Hire firm or your HR Manager, if your car use t&cs do not support this deduction for a mere invoice (as opposed to a fine/penalty).
Europcar are one firm which will refund the admin fee if you win your appeal.0 -
This is an IPC AOS; appeal around 20 - 25 days applies to BPA operators who have issued a windscreen ticket. Whoever owns, keeps or drives the car has no relevance to IPC members - they assume them to be the driver.
@OP - you need to have a much closer and detailed read of the sticky - it can't be done on a skim. You need to read it and the advice given in the context of IPC AOS operators. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Can I just ask, what would you do if you came home and someone was parked in your driveway while they went to the shops?0 -

Park nearby, wait for them to come back, size them up from a distance, either send them off with flea in their ear or leave well alone, re-position your vehicle.0 -

wash and valet their car for them ,
I see no mention of DRIVEWAY in the OPs first comment !0 -

He would have 2 choices.
1. If there was a PPC in place clear and coherent (difficult for most) signs and with the requisite authority the PPC could take the "offender" to court for breach of contract.
2. If there was no PPC in place, then the occupier can sue for trespass and damages.
Don't think there are any other options. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
The car park is always empty during the day, it's not a busy town like that, but it just doesn't have a lot of normal parking during lunch times etc! And there's glass on the floor in the space i was in to top it off!
I work for DHL so we have our own fleet management who have the V5's etc, i'm guessing they will get the ticket and send me an email about it but i don't think they will pay it?
So in summary do you think I should warn my fleet team anyway and proceed with sending the letter after 20 days?
Thanks!0
