I'd also advise being pleased that you've got all your money back and move on. Isn't your health and your family more important than what your ex-LL does with future tenants?
You could always send a letter to the next tenants and suggest that they check that the LL has complied with the law if you really can't drop it.0 -
Thanks, I hadn't thought of contacting new tenants but I think I will. I am sure within a week I will feel more sensible about pursuing it. As I mentioned earlier I am not interested in a profit I am just angry with the way they dealt with it. Still feel emotional as it has happened so recently and severely effected our weekend.0

Unless you love sleepless nights and tremendous amount of stress on something you may or may not win you did the right thing.if you do go ahead with this I would be interested to know how it goes and the outcome. Part of me wishes I had sued a landlord a couple of years ago (I'm in Scotland so I've run out of time) as she was an absolute cow. It would have nice hitting it where it hurts...in her pocket. Would it have been worth it though I really don't know.0 -

Why would I have had sleepless nights or a tremendous amount of stress? I didn't need to money and my deposit was never protected. As far as I can see there is no defense against failing to protect the deposit so the judge (or sheriff in my case) would have had to reward something which I would just have donated to Shelter Scotland. I could have treated it like a hobby.
Instead I opted to report her to the council for not being registered as a landlord (a criminal offence up her) and gave the council the address of all the properties she lets out in the city and they have done nothing. Absolutely nothing and she still isn't registered as a landlord. So sometimes I do regret not suing her. Apathy lets these rogue landlords continue to operate.0 -

If the tenant had left the place spotless and the landlord refuses to return an unprotected deposit I would say sue.
Here you have a tenant who suffered no monetary damages in the end and a landlord who did with that dirty stove.
I've been before a judge, not as a hobby but for real, knowing the outcome and I found it stressful.0
