Court - Accelerated Possession - I have no paperwork

The LL said he is going to go back to court to ask for the possession order on 2nd November. The way the court is reacting, refusing to give me copies of the documents personally, I am pretty sure it will just all go through as if I am not even trying to sort the forms out.
How did the landlord answer Q8 on the N5B application?Well life is harsh, hug me don't reject me.0 -
It looks like it was the court (why documents didn't turn up). I phoned on Friday 23rd informing I had not received the original possession claim forms. Was told another copy would be sent first class that day. When I went to the court Tuesday 27th was told documents had been sent out Monday. They turned up today, post marked 28th. Why they wouldn't give me copies on Tuesday I'll never understand.
I had til 29th to make any response as deemed as served on 15th. So that's gone.
I would have preferred to be able to ask in the response for time to pay. LL is not as reasonable as it sounds. He will probably take the money out of the deposit. He did suggest this. The way costs are stacking up (£280 already, then Bailiffs fees), there won't be much left. I'd rather pay for my own eviction (sorry but I do think having to pay for my eviction because LL wants me out is a little wrong) as slowly as possible as this is not going to be an inexpensive time. But that opportunity is lost. I didn't expect costs for a possession order to be as much as they are.
I've been trying to contact LL to find out if he can get Bailiffs order dated for beginning of December so not too close to Xmas but gives me enough time to deal with my furniture (because of back, takes me a lot longer to do packing - sitting with a hot water bottle now) but he's not replying. Possession order is already coming a lot faster than I calculated (was told with court date delays would be 6-10 weeks, it was 2 for claim to be issued). I don't know how long it will take for bailiffs warrant to arrive but with what happened with possession order, worried I won't have time to pack and store my stuff.
Electrics went funny tonight. Upstairs switches were turning downstairs lights off (the wiring here is very questionable).
Had Sanctuary Housing visit yesterday. They told me I have a very strong case for being found homeless. To my surprise they said I can't be left without anywhere to live because I am a diabetic, never heard that before.
Just keeping everything crossed. Not a lot else I can do (except pack as speedily as possible lol). Putting furniture in friend of a friends storage container. Been told its dry.Selling some stuff, putting it on ebay this weekend. Its all tat but well, we'll see.0 -

I had til 29th to make any response as deemed as served on 15th. So that's gone. - But you've got the envelope, so you can still go to the court today and submit a token defence. With a covering letter explaining that the papers were not received until the 2th.

He will probably take the money out of the deposit. - He might not be able to. depends what the tenancy says about the deposit. The way costs are stacking up (£280 already, then Bailiffs fees), there won't be much left. I'd rather pay for my own eviction as slowly as possible as this is not going to be an inexpensive time. But that opportunity is lost. I didn't expect costs for a possession order to be as much as they are. - Its a small investment when you consider you'll get social housing.
I've been trying to contact LL to find out if he can get Bailiffs order dated for beginning of December - Wont have much choice in the matter. Bailiffs will set the date, they'll let you know in advance. so not too close to Xmas but gives me enough time to deal with my furniture (because of back, takes me a lot longer to do packing - sitting with a hot water bottle now) but he's not replying. So far the courts have just done admin, which ofcourse doesnt take much time at all. I don't know how long it will take for bailiffs warrant to arrive but with what happened with possession order, worried I won't have time to pack and store my stuff.

Good luck.0 -
Deannatrois , I know little about landlord and tenancy law but much of my day to day work is connected with the courts in a different area. I quite often receive notices that this or that needs to be submitted and sometimes these reach me only hours before a deadline. I've found that they are very helpful when it is clear that a communication simply has not got to where it should and am wondering if you might try contacting them to explain that because the notice has been L set in reaching you, you have not had the appropriate time to respond. Worth a shot perhaps
A dreadful situation, andI do wish you luck and successI was jumping to conclusions and one of them jumped back0
