Court - Accelerated Possession - I have no paperwork

So you are one step further on from your previous post, where you said that your landlord was looking to evicting you.
It does seem that your landlord is keeping you informed - a million times better than bailiffs turning up unexpectedly.
Has the council indicated the sort of accommodation they will provide temporarily?
Is there still nothing available that you could find for yourself? Does your council operate a bond scheme for those who can't provide a deposit.
Yes, the LL is keeping me informed. If he hadn't phoned to get a date when I was moving out (ha ha, I'd love to know this too), I wouldn't have a clue that he'd applied for a possession order.
The council have said verbally that they will not now seek to place us in one room shared lettings accommodation (because of the case I made against this). But we'll see what happens.
The council, when I met with them, did not disagree that private Lettings in this area are too expensive to afford in this area. LHA for a three bed is £750, rent for a 3 bed is roughly £950 plus. I have yet to find a LL or LA who will deal with a benefit recipient. I have looked very hard. But I have to be totally honest, being with a private LL who's been saying he wanted to sell since last September (encouraging me to decorate which caused a lot of pain because he said he'd get another LL to buy but didn't) and all the stress and ructions this process has caused has made me very reluctant to go for another private LL if I can possibly avoid it. This private tenancy has been a roof, yes, but its been four years of hell with no repairs being done, I've had to do them all. Environmental Health just sent a letter to the LL which made him very angry. The things that are supposed to make a tenancy ok for a tenant just don't work.
I know you are going to suggest i should move out of this area. If I move out of this area, I will lose the services I have already managed to obtain for my sons. You have to deal with waiting lists. I have waited a year for an appointment to have my older son's ASD reassessed so he can be given help with coping skills, 3 months for a specialist social worker (who is only now, 6 months later getting up to speed and requesting a PA for him), its taken me til now to get my younger son's school to respond to his needs, a new school I'd have to start right from the beginning again as they always say they need time to get to know the child regardless of what paperwork the other school sends them. That's if I can find a school that deals with ASD special needs at all (most don't I have found in my 10 years plus experience of this).0 -
I get that you have access to things you need where you are, but surely being homeless is worse than having to start again with that? I would seriously look at other areas, baring in mind the access to the services that you need as well as the price. Do any of the austism charities have details of the best areas for access, so that you can check out prices in those areas?0

Well I know Wolverhampton doesn't because that's why I moved here.
Ok, so I move to another area. Please explain how I drag two young people who find areas they don't know terrifying (and stop them running into the road, throwing themselves on the floor - my older son has already given himself head injuries collapsing) so I can find accommodation in one day.., and then travel back with them on the train they find equally frightening. We can't even go on holiday! And where do we stay meanwhile (I don't drive BTW). And how do I stay sane while trying to deal with them and find somewhere to live? Honestly, I have been there, trying to keep the other boy calm and safe while one is going into meltdown, its not pretty. We had problems coming home from Dartford today.., its a few miles away (2 train stops).
And no I have no one to look after them.
You see, these ideas sound great.., I understand why you propose them, honestly. Just not so easy in practice. Sorry I KNOW I sound defeatest. I hate it too. I do wonder if I'm my own worst enemy. I truly don't know what to do. That's why I feel so bad. Is it all my fault? Am I any good for my wonderful boys at all when I can't even provide them with a home? They deserve so so much more than I am giving them. I'm trying so hard.., but I don't seem to be even getting to first post. Maybe I am just doing the wrong things. But that just makes it harder because I can't find any solutions.0 -
Unfortunately with the issues that they have any of the options facing you are going to be difficult for your children... Maybe if you can find something that looks suitable on the internet and then go during the day whilst they're at school?
If you've tried the housing charities and got no help, have you tried autism charities as well?0 -
going to back off for a bit. Sorry.0

I've looked at the Form N11B (many thanks indeed Franklee) , don't intend to defend but would like to ask for time to pay and possibly an extension (I am experiencing delays getting my stuff stored.., a friend is supposed to be lending me access to a storage container but I haven't seen it - it may not be water tight from what he said, have no access to it as he's on holiday and because I've only just learned about the accelerated possession order, I have no idea what I am dealing with).
The LL said he is going to go back to court to ask for the possession order on 2nd November. The way the court is reacting, refusing to give me copies of the documents personally, I am pretty sure it will just all go through as if I am not even trying to sort the forms out.
But I just don't know what I am doing, how to word it, what to say. And time is running out. Sanctuary Housing were supposed to come round yesterday for an initial visit (to give advice) but they cancelled because they needed to deal with an eviction case in court that day (understandably).
I feel like I am a rabbit standing in the headlights, if that makes any sense. It just seems hopeless. Can't get forms, getting advice on here but telling me to move to unknown area.., and I am running out of time. Freaking.0 -
I'm giving up. There's nothing I can do.0

Just remember that even after the court case you'll be waiting for bailiffs letter, which could be weeks.0
-
It could be there's a typo in the address. Or it could be the documents are still in the post. I would have thought you should at least phone the court to check the address they have as whatever happens it is essential that you get the letters including future ones! I would follow up the phone call with a letter to the court giving your correct postal address and listing the non appearance of the documents.0

This ^^^.
Unless the landlord goes for an accelerated possession, but that would incur greater costs, so may not happen.
I wouldn't worry too much about the court costs you are incurring. Your priority is to secure housing. Any money you owe the landlord can follow once you have housing sorted. The landlord will realise that you don't have cash to spare and know he is more likely to see some money if he holds off.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
