Hi there folks, completely new to this...
I have been issued a PCN CODE40 Which is parking in a disabled bay. This happened in Boston in Lincolnshire, I am not from the area so no local knowledge of this town.
I am appealing as I believe that the area was not properly marked the nearest sign to me was 5 cars away, I can't say parking bays as these where not marked out. So its known as a parking place!! Also in the same area was a notice for loading, which is what I was doing. In fact the spot that I parked at there where letters marked out 3foot high stating KEEP CLEAR LOADING ONLY in an arch nearly 5 mtrs long. There was a sign right at the entrance to the pedestrian zone 250mm by 120mm stating this area was for loading only. This sign was 80 meters from the highway. ( This was pointed out by the CEO he also pointed out the disabled sign which i had not seen 5 car widths away. )
I have appealed and this has been rejected as it may have caused considerable inconvenience to a blue badge holder. My pictures show the loading bay empty and more parking spaces.
I am now at the Nto stage but am struggling as i dont know the law or what really to do. I now know there is disabled parking in that area I also know there is a loading area not 3 mtrs away, non of which I knew on the morning of the issue of the PCN.
I just think there markings are very very poor. Disabled bays should be marked not disabled places!!
Any help out there be very much appreciated.

Welcome to mse, bab - well done for finding your way here when so many victims of these scams don't.
You need to get stuck into the newbies stickies which head the Forum Thread titles' column. It needs more than a skim through.

If this is a council PCN then it needs taking over to PePiPoo.
As we tend to major on private parking tickets here, PePiPoo will be your best bet. Here's your link:

Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need photos/scans of all correspondence you've received from the council (both sides, if appropriate).
PePiPoo has an excellent success record in dealing with council tickets.

This must be at the end of WideBargate in Boston. Tried to paste a street view link but it only showed the map view.
The parking area has only 5 or 6 spaces and the disabled sign is at the end rather than the middle.
Also as well as the LOADING ONLY on the road there is DISABLED at the point of entry to the parking area.
If the OP was 5 car lengths away from the sign they were pretty close to the DISABLED on the road.
Street view shows it clearly.
Pretty sure it is a council area.0 -
Hi there folks, thanks for all the interest and info.. As I say I am all new to this kind of thing.. The CEO who issued the ticket annoyed me with his answers on the day.. It took him longer to walk to the disabled sign than it did to issue the ticket with me stood beside him.
Info I put down for my NTO came from there own CEO enforcement rules. Park or parked is classed as "some time stationary" whether driver is in the vehicle or not. Also the sign pointed out to me constitutes a parking "area" not a bay...
But the sting in the tail is the sign pointed out for loading and unloading also covers a parking "area"...
I have replied to the NTO for confirmation weather the area is for loading/unloading as in the 3ft high letters spread or a 40ft arc. Or is this a disabled area as noted in there 14"x8" sign..
It's just confusing..
Thanks for all the help so far..0 -
yes this is the end before the pedistrian street. a place for loading and unloading..0

Thank you, navigation through this is slow.. If I had half the knowledge of some of the people on here..
The CEO on the morning was a complete !!!, even the lady who parked next to me told him to catch himself on that I'd only been there 2 minutes...
But I'll fight as long as they keep the poor signage that is there...
