    I feel I must ad more to the situation I didn't put all this in before as I didn't think I would get any answers.

    Myself and my ex had lived together for 5 years before I purchased the house. She was married and in the 5 years she got divorced. When I first meet her she had got into debt badly and I helped bail her out.

    I also bought vehicles in the five years where she had full access to them and I put her on my insurance. I also took her on holiday to florida paid for on my credit card.

    She always insisted that when she had a settlement from her marriage she would pay me back. So when she got £15000 from her marriage she paid me back £10000.
    I decided that I would insure my sons and mines future buy purchasing a property nowing when my son leaves scholl he will never be able to buy anywhere to live or even rent.

    At this time my relationship with my ex was going down hill and with my history of ex's where I was left with nothing I decided to purchase the property on my own. When I bought the house I what to renovate it as it was in a bit of a state and then sell it on to make a profite.

    My ex asked me if she could rent it from me which I agreed as it helped me to pay the mortgage.

    We had a tenancy agreement and rent book. And I have found out now she was also claiming rent from the housing association.
    She never paid towards the mortgage only in the form of rent. The house and mortgage are in my name.

    Ahe has gone to a solicitor and told them that the £10000 she had paid me back was for deposit for the house and so is tryng to claim half.

    Sorry that was long winded but thought as I got so many replys I have to put down all the facts.

    My solicitors tells me she hasn't got a case but I have been in the same situation 12 years ago and lost everything. That the britsih justice system for you.

    I don't want this to happen again as I have spent £20000 on the property in 4 years and she has piad nothing only her rent.

    that puts a different spin on things. i was about to let off steam saying she should be entitled to something - but probably, legally isnt.

    my partner brought our house in his name. i was too young to have a mortgage at hte time BUT i still contributed to it and paid lots of bills - had we broken up id have got NOTHING back, luckily we're still together but i still hate to think that legally, id probably never get anything back had we split up.

    This point is particularly relevant, and accurate. It is an equitable concept called substance over form.

    You have also identified another problem, in that you have no proof that the money given to you by your ex was not towards the deposit for the house.   • You can now see the situation I'm in, and why I first asked the original question about selling my house to my parents. Not to avoid paying her as I don't owe her anything but the fact that I don't trust the british justice system having been stung before by an old ex who lied threw her teeth and the courts believed her and not the truth I was telling.

    I'm really worried about this situaton and I'm trying to protect mine and my sons interest. I don'y want to end up like I did before. My ex has done this before to her ex husband and she got £15000 out of him but they were married.

    I saw what she could do then and wanted to make sure that that didn't happen to me.

    It is certainly more clear cut when a couple are married, though still not simple!
    My question is can I sell my house to my parents for a £1 or £10.

    Do I have to inform the mortgage company or can I transfer the mortgage to my parents.

    You can sell your house to your parents for a nominal sum. However, even on the simplest level, there are tax implications in the transaction (unfortunately I don't know what they are, I'm sure someone will).

    I have a feeling that it is possible for a person to register a constructive interest as a charge on a property at the Land Registry. If your ex did this, you would not be able to transfer ownership of the property.

    If you wished to transfer ownership of the property, you would need to transfer your mortgage to your parents. This would depend on them being able to afford the mortgage, and would be a decision to be taken by the mortgage company.

    Finally, going back to the substance over form issue, if the court did believe your ex's story, they would see what you had done, and order you to pay your ex the relevant amount of her 'interest'. The fact that you had sold the property would be irrelevant to the court, you would still be liable to your ex for her share of the market value of the property.

    My personal opinion is that it would do you no favours at all to 'dispose' of the property.

    Sorry that some parts are vague, I studied all this a fair few years ago now!

  • err, does that mean I can go chasing up all my ex-boyfriends (and there have been a few!) for 'unclaimed monies owed from Property?'...maybe Martin could do one of his reclaim articles? :money:



    On the flip side, if a property has decreased in value, would I have to share that burden and possibly help some of my ex's get out of debt quicker?...hmmmm
