A couple of years ago, I bought some pc games from Ebay, having, as I later realised, a stock photo for illustration.
When received the games were obvious copies on discs with the sellers own brand (plain labels with an animal logo). They claimed an obscure law (actually valid in US for certain sortware) which allowed them to copy.
Ebay were not interested in the breach of copyright, suggesting I contact the game manufacturers(which I did), but agreed I get a refund, on the condition I returned the items by recorded delivery, which meant effectively a few pence back, as my (eachway) postage was not refunded.0 -

Valid in the US does not always mean valid in the UK.
If they are a business seller they need to comply to all UK laws. That includes laws regarding copyright and selling.
When you confirmed from the game manufacturer that it was fake ebay should have refunded you without you having to return the item. Did you state to ebay that it is fake and send them the evidence from the manufacturer?
Business sellers by law should pay return postage costs on items being returned as not as described.
Ebay can't enforce it though. However, you should have asked for a returns label from the seller and, failing that, asked ebay rather than paying out and hoping for a refund after on return postage.0 -
Its pass the 6 months chargeback date, therefore eBay & paypal won't do anything. Hit the block button while sipping some fine English tea.
