    a few FOI requests should also make them do some work that they dont wish to do

    I shall look at getting a response drawn up to those 2 you mentioned. Any particular points I should focus on for a FOI request?

    That's the thing, I don't think there is one! It's very condradictory, the UCS letter says the client is the NHS hospital, the reply states the contractor is responsible, the signs (as far as I can remember) didn't state anything!

    They included images in their reply of the car etc. and the notice on the windscreen. The image of the sign is essentially the following (no other logos etc.)

    Pay & Display
    Please find a space first
    <disabled logo> 14 disabled parking spaces

    This could be the entrance sign to that particular car park, I can't quite remember. There is a much larger sign next to the pay and display machine, but none around the car parks at all. So I think the Trust manage the parking themselves.

    Oh yes I see, that's on the notice to driver so sounds like they manage the parking. The DVLA said they were happy that Solution Labs (part of UCS) had requested the details correctly on behalf of the NHS Trust, but potentially it was actually on behalf of this other company?

    I know the IAS aren't the best to deal with, but within their CoP they state that a member of theirs cannot pursue parking charges on behalf of a third party. It sounds like this is what UCS is doing, is it worth the complaint to them?

    If the parking contractor is not in an ATA:

    I would reply to the DVLA (David Dunford) and say that the NHS Trust has admitted a contractor deals with the parking enforcement and that UCS obtained your private data for that unregulated contractor. So this was not a case of data obtained for a landowner under any 'reasonable cause'. Closer inspection of the PCN shows it was issued by ISS Facility Services Ltd so you wish to escalate this complaint. It seems that UCS was wrongly allowed by the DVLA to obtain data for a company carrying out 'parking management' (according to the NHS Trust who have said in writing 'car parking management is provided by a third party contractor').

    Yet ISS Facility Services Ltd is not an AOS member. And you suspect that your case will not be the only one and you fail to see why this has been allowed because a parking contractor MUST be an ATA member for UCS to get data for them.

    Attach a copy of the PCN and the subsequent letter(s) from UCS and you will also need to forward to the DVLA the letter/email from the NHS Trust as proof that they do indeed say: 'car parking management is provided by a third party contractor'.

    Just checking - are ISS Facility Services not in the IPC? I had no time to check in detail but from reading the thread and on their website I saw no evidence of a BPA or IPC logo.

    ISS Facility Services usually handle cleaning contracts and the like ... never heard of them doing parking "management" before.

    Part C, Section 1, point 1.7 - You must not apply for keeper details on behalf of any third party company or individual who is not a member of an Accredited Trade Association

    However I noticed this section was headed "Applying for Keeper Details where Keeper Liability is Sought" so may not actually apply in this case.

    RE: ISS Facility Services

    I've had a google and can't seem to find anything related to parking or the IPC. The member list does not include them, but not sure if they are hidden under another name (like UCS is for Solution labs)

    Is it worth confirming with the hospital first? Or go straight to David Dunford with all evidence I have to date?

    Go straight to DD, it's up to him to check whether they are in an ATA. No need to quote IPC's CoP, no need to quote any CoP.

    They do not appear to be ATA members, from the ISS website. And I think UCS may have form for dodgy DVLA data use before, in the past. Your complaint could be another slap on the wrist/nail in the coffin for them.
