My cousin got a summons just because he didn't swipe his card out at the end of a journey or something equally silly. Anyway, he went to court (as he couldn't get out of it), explained the situation coherently and with respect, and they let him off. Everyone else who was there got a fine (mainly due the fact they had not turned up wearing a suit or taken the thing seriously and didn't have anything to say when presented with the case against them).
Just go to the court date, explain that it was a genuine mistake, that you've never had a problem before, and that you told the inspector this at the time. I would also write a letter to them explaining these circumstances so that they have something in writing from you beforehand. It really is not worth their while to prosecute for this.
I agree with the points you make. My SIL is a magistrate and she said that it is really importnat that you turn up looking smart, be respectful and polite at all times.
Explain that it was a genuine mistake.
Then keep your fingers crossed

My guess is you didn't offer to pay the difference, or buy the actual ticket for your journey?!

thought i have to pay panelty for this and they never gave me a chance of paying panelty. I was waiting for their response for some kind of charges I would have been happy to pay for the mistake i made, but summons :eek: i think they just thought to give me heartattack.

one more thing they said in the summons that if i accept that i am guilty i need to pay 100 pounds and the case be closed.
Will this effect my employement, or the chances of getting a new job where i have to get CRB checked or not?
Will i have to mention this in the application forms for emplyement where they ask if i have any criminal conviction???
I am just not sure how being guilty of TFL would could effect my future. If anyone have idea

Get yourself a lawyer who deals In 'criminal matters'
not just a local high st solicitor who deals in civil matters.
ask to postpone case . you are entitled to legal help,
lawyer will advise if he thinks you are not guilty , if guilty see below.
15 years ago there was no CRB but lawyer did research. I was advised the fare evasion is only shown on local court records, the test for a criminal record; is if it goes on PNC Police Nat Computer, lawyer told me it wont. He said it was matter for LT only not Police.
bear in mind local news reporter may list your case ,if your unlucky.

I will answer your questions in a minute. But if you are concerned about the CRB (and a lot ofpeople would be concerned) then seek advice from a lawyer who knows criminal law. It is worth paying his fees to know where you stand. Dont plead guilty until you are properly advised. But for fare evasion you MAY notneed to give them.(I think) DNA is your unique human cell make up , hair , sweat etc, everyone is unique.Prints are fingerprints. again unique.non predujice, means pay the money(fine) but without admitting any liability/guilt.They now have your date of birth. Here it is in simple terms!
1: Turn up at Court, on time and smart.
2: Be polite and honest at all times. Don't make your story/case to long.
3: Explain to the Magistrates it was an honest mistake. You either get let off or fined.

Well what i was thinking was to just avoid this because they have my name wrong so its not me. two people with a different name can be born on same day, But they have my address, and my maternity exemption NHS No. is the record they have of me is varified on name and DOB? If thats the case then i would just not worry about it.
If i just forget it all together whats the worst can they do? Cos i think i have already had summons for being honest. But this part make me think, can they go about for months or years and find out that it is me and then it will be a big issue?

In my opinion, it is just that, an opinion, I would not ignore the summons. It will maybe bring attention to yourself. Plus they have your details.
Have you checked your private messages Romi ? just in case there is something for you. You never know.

It could help if you provided evidence that the Student Oyster card was legally held, and could legitimately be where you picked it up from by mistake.0
