    4) A stay in proceedings is consistent with the approach of the FSA and the FOS which has decided not to progress complaints about current charges until the outcome of the test case.

A stay in proceedings only affected those whose case had not been resolved yet, or had an offer made by the banks. The FOS are not asking for money back, or cancelling offers already made.

You won fair and square, and this is yet another abuse that should be reported to the FSA.

MCOL said last week that judges should not be allowing this.

No worries Chris, I'm making it my mission to stick the boot in HSBC now, so anything I can do that might help that cause is time well spent in my opinion!

just out of interest.. do you still hold an account with them?
Mine has been suspended as i havent used it for a few years, wondered if that was why they were going for this case rather than ones with larger claims
  • I opened a parachute account a few months into the claim (started back in Feb) and now have my salary paid in there and all DD's come out of new account, so I guess you could say it is inactive...but still open.

I think they're just playing hard ball now and trying new tactics.
  • Update:

Got a letter from the Financial Ombudsman yesterday to let me know that they are looking into my complaint about the bank not paying out on the judgement/delaying tactics etc.

I'm sure I'll have to wait an age to get a response, but hopefully HSBC will get into trouble. Am I wishful thinking? Probably. Hey ho.
  • nice one, i read somewhere thats an automatic fine for them if they start to investigate something?
  • :rotfl: or should that be a fee for a service :T
