Emirates EK038 delay June14th 2015

Hello, I would like to know if anyone has successfully claimed against Emirates Airline for the delayed / cancelled flight EK038 on June 14th 2015 from Birmingham to Dubai due to a mouse on board. I have e-mailed them twice but they say I don't have a claim under regulation EU261/2004 because it was due to extraordinary circumstances and beyond their control. My next e-mail was going to be to the CAA but Emirates told me that the CAA has agreed the delay was beyond Emirates control. I feel it was not beyond their control because it is ultimately the airlines responsibility to ensure passenger safety and well being. Therefore systems should be in place to prevent this sort of event from happening.
