Private car parking

Hi, a while back I got a car parking fine, from my place of work (a hospital) for parking in the wrong place. I ignored this and subsequent letters, thinking as discussed on this forum, they couldn't do anything and had no real rights. I then got a letter from a debt recovery agency, I sent them the letter downloaded and still haven't paid. I have now received another letter from private eye, the car parking company, in which they say:

if this letter is ignored further action may be taken, including referral to the credit reference agency to confirm correct address, instruction to solicitors to secure payment, referral to debt collection agency.

It goes on to mention the case of Parking eye verses Beavis, in which the court of appeal said the payment had to be made. Does anybody know anything about this case?

I feel like this isn't going to go away and am worried they may contact the credit reference agency and the consequences of this.

    A couple of things first:


    1. The parking company is Parking Eye, not Private Eye.
    2. They "forgot" to tell you that the Beavis case has been further appealed to the Supreme Court, and so is not yet concluded.


    You're quite right - it's not going to go away. The bad news is that Parking Eye is the most litigious of the Private Parking Companies and will take you to court unless you do something about this. The slightly better news is that it will only have an effect on your credit rating if they take you to court, you then lose and then do not pay in the prescribed timescale, resulting in a CCJ.

    Well I've sent an appeal e mail. I guess I'm going to have to keep doing this every time I get a letter. As long as I know it won't impact my credit rating I can put up with this. The letters are very worrying though, almost intimidating, I've never missed a payment for anything in my and would hate to think this could have a negative impact on my credit file all for just going to work.

    I am not sure if you can still successfully appeal at POPLA at this stage but the buys on the motoring forum are really clued up. Hope you manage to get it sorted.
