    Hi Danish again.
    Just received an email from AOS almost verbatim of your last one but doesn't refer to POPLA in mine.

    Anyone know if there is an overall time limit associated with this appeals process ?
  • It seems clear to me that AOS/BPA have no clear plan as to how to deal with these appeals.


    They have given no indication that the appeals will get a fair independent hearing any time soon.


    Given their track record, and the dealings I have had with them, they are at the behest of the PPC's and so are likely to do nothing at best.


    The only way I can see that I can get my appeal heard properly is in a court of law.


    My first thought is to withdraw my appeal and make the PPC take it to court but I don't think they will do that.


    That would only leave the possibility that I then took them to court with all the hassle involved.


    If anyone has any bright ideas as to a better course of action I would appreciate any suggestions.

    The appeal is only binding on the PPC, so if you lose you can just wait for them to maybe take you to court. There's really no benefit in withdrawing an appeal; in fact they might even use it to try and claim you're accepting guilt.

    I understand both of your views.


    Leaving it to pan out is one option, but this fiasco has gone on for so long and I can see no imminent resolution. Unfortunately it is not in my nature to sit and wait and my patience has come to an end. I am finding it all quite distressing having this thing hanging over me, illogical I know.


    The objective of the appeal is not primarily to avoid paying the invoice but to prove the PPC were acting beyond their remit in issuing it in the first place.


    I have no faith that we are going to get proper hearings as it stands, so there is no point at all in the appeal siting in the pile at the BPA.


    If the PPC were to say withdrawal was an acceptance of guilt it would at least mean they have taken me to court.
  • Grandad123 - I think you may be right the that the BPA currently doesn't have a plan to deal with the backlog of 4,000+ outstanding appeals from "old" POPLA (including 3 of our own).

    However, The Deep is right; the best thing to do for now is to sit tight and wait.

    It appears that I am overreacting by the responses, but it appears to me all the work that I have done with the appeal is wasted.


    The nice chappie who issued my PCN is still out there, in all his ignorance, dishing out tickets like confetti counting his bonus and abusing anyone with whom he disagrees.

    I sympathise. I am in the same state. I am with my new friend Edna on this... sit-tight, wait, gloat for now in the satisfaction of gumming up the system and causing the PPCs and BPA an admin headache.

    So, what's the worst case. We get our appeal heard by "IPC-type" assessors who don't follow old-POPLA reasoning. Ok so the appeal is unfairly dismissed. Great - now PPC, bring on the small claims cos I still have a prima facie case to win. Oh and by the way, sitting in POPLA backlog just consumed a bunch of your six years statue of liabilities...
  • Tedious tedious... why am I so impatient. The longer this goes on frankly the better... but deep down I want to have my ADR fight... especially as I have them on NTK served too late with no NTD.
