Upgrading to W10 isn't going to magically fix a failing battery. What does the error message say exactly ?Science isn't exact, it's only confidence within limits.0

buy a battery and don't go to W10......Gettin' There, Wherever There is......
I have a dodgy "i" key, so ignore spelling errors due to "i" issues, ...I blame Apple0 -

I would suggest waiting for more of the creases to be ironed out of W10, you have until July 29th 2016 to take up the free offer so there is no need to rush.
If you do want W10 now then I would suggest doing a full system backup (or at least your important data) to an external drive just in case something does go wrong, it's much easier to restore that way and you have a back up. Operating system upgrades are for the most part are trouble free (or minor issues) but you just never know. You should back up important data anyway.
The choice is yours.Science isn't exact, it's only confidence within limits.0 -

Before buying a new laptop or upgrading to windows 10 why don't you try installing something like Ubuntu on it and giving it a whirl, you may be pleasantly surprised.0
