HP Printer - Faulty after 1 year & 4 months - What are my rights?

Hi all

I have a HP printer that has developed a fault after 1 year and 4 months. The retailer I purchased it from says it only has a one year warranty, which is also what HP is saying.

However, it is my understanding that all goods purchased within the EU have a 2 year warranty? I have sent the retailer the link explaining this but they refuse to accept this?

I would appreciate some help as I find it extortionate that I've paid £250 for a multi function printer, only to find that it when it develops a fault barely over its one year warranty, I'm left with nothing! Aren't goods meant to last a minimum amount of time or something?

    Your EU bit is wrong .
    UK law sale of goods act gives up to 6 years to initiate a claim .
    That is a claim not 6 years warranty .HP can offer what warranty they like but that is not your SOGA rights .
    As the item is over six months old you need to have the item examined by an independent engineer . If the report then points out it was a manufacturing defect or the product could reasonably have been expected to last longer then you can claim against the vendor .

    Who pays for the independent engineer? Also, I'm not too clued up but where would I find an independent engineer?

    Can you post said link about the eu and the 2 year warranty.

    A £250 printer should last longer than the 16 months, you might need to get an engineers report to prove the fault was there from the start.

    Eg "printer engineer report" then maybe your area.

    I believe the retailer reimburses you, there's a link on mse about the whole item is faulty and soga.

    I've rang the retailer and they are adamant that after 12 months, the product has nothing to do with them. I'm worried that if I pay for the independent engineer, I won't be reimbursed by the retailer.

    Furthermore, should I not quote the EU law anymore and instead quote the SOGA?

    In the previous legislation goods had to be 'fit for purpose'.

    For me that would mean that even if the fault developed after the original 12 months had expired on the product ie this £250 printer, the 'fit for purpose' clause would not be satisfied.

    Goods of that price would be reasonably expected to last longer without fault than they have.

    Some years ago I purchased a fridge/freezer from Comet.

    After 2 1/2 years the unit broke down but comet refused to repair it because it was 'out of warranty.

    I sued them through what was called then the Small Claims Court.

    I won the repair cost plus expenses.

    I hope this latest legislation does not in any way reduce the 'fit for purpose' clause of the old consumer rights laws

    I'm going to send them a letter quoting the sales of good act and will see where it goes from there.

    Who is the retailer? Sounds like the sort of response that Currys/PCWorld give. Regardless of what the retailer says SOGA applies to them (assuming they are based in the UK) so the chances are that if the report does find that the fault was inherent they will back down after a LBA.
