Orange Upgrade - can I be mis-sold a tariff?

Afternoon all,
Having just contacted Orange to find out when I can upgrade/cancel my account, I was put through to a very helpful lady who explained everything clearly and offered a rather good package that seems to good to be true but I unfortunately can't take up until Dec 07 becuase of my current contract (taking some 3 month loyalty deal into consideration).
The helpful lady also explained that she couldn't believe the tariff I was on saying it was no good for me and that I had been on it since 2004. I advised her that this was taken with the best advice of Orange, and I thought I was put on a different tariff when I took on my new phone nearly a year ago.
So two questions, firstly if I've been on this tariff since 2004 and it hasn't changed since 2004, I must have gone well past my 18 month period so surely I can cancel/upgrade now rather than wait until Dec.
And secondly, I must have been mis-sold this tariff as I asked it to be based on my current useage. I believe this is the case if the lady I was speaking to was gob-smacked at the tariff I was on. Especially when I'm paying £50 a month and the tariff the lady offered me was £15 a month??? There's a big difference here!!
What's your thoughts? Any idea if I can do anything about this?

You would have started another rolling contract term which is why you can't upgrade/cancel your account yet. The new handset is used to tie you in for another term i.e. not really free.

if you are taking a new handset every year then most likely you are entering into a further 12month contract each time, regardless of whether you changed your tariff or not.
With regards to being missold the contract, you initially accepted the tariff and more than likely when you wanted a new handset they may have asked if you were happy with the current tariff... unfortuantely it is down to the consumer to pursue a tariff reduction, at the end of the day they are in business to make business!SLC: £13000+

Valued Opinions: £75 (paid) + £52.30 (received) + £4.50 (pending) = £131.80
StudentPanel: £250 -
At the time it may have been the best option for you. Like z4kir says, it's not the responsibility to tell you when your tariff is no longer working for you0
