Mbna ppi pre 2009.

Has anyone had any success claming ppi from MBNA pre 2009..

    Yes, I had about £389 via a claim company - big mistake but it encouraged me to check whether I had PPI on anything else. Got another claim in for my wife and mum as we speak - these go back tp around 2000-2005 as well

  • just had conversation with mbna ,they are trying to say not missold and refer to a letter back in 2010 sent to us? Then tried to say it was out of time for Ombudsman - wrong - it is 6 years !

    Mbna have their own set of rules, and the omburdsman has a high percentage of referrals regarding Mbna, lets hope they see through what this company opt for, immediate rejection of most claims.

    I do believe, it's 3 years from when they made you aware. ie letter sent in 2010.

    There are two timebars. 3 years and 6 years.

    It is 6 years from the purchase of the product or 3 years from being reasonably aware of an issue. Whichever is the longer.

    If they sent a letter in 2010 with an invite to complain if you felt you were mis-sold then that would trigger the 3 year timebar. Not the 6 year timebar.

    Timebars need something to activate them. A letter is one of the most common things to do that. There can be other things but its the letter that is most robust.

    Im expecting to get timebarred even though I have had no communication since I paid off card in 2007, I have copies of statements and I have copy of application form where there was no mention of the terms and conditions for ppi just it was 78p in the £1. I had covef via works sickness plan 6 months full time and 6 months half pay, so plenty to pay the balance.
    Mbna are so frustating, they just dont want to knnow, refusing to accept any blame or to undergo investigations just timebarring claims.
