Single Yellow Line on Private Road

So recently I visited a friend and due to him living in a flat, I had to park on a street nearby. I figured that it would be fine to park on a single yellow line.
Unfortunately I returned to a ticket on the windscreen from UKCPS stating I parked without a valid permit or authority.

After researching, it turns out that the last section of road, which I parked on, was private. Doh. These guys are IPC so no Popla.


I did search, but had little results referring to single yellow lines on private roads. This isn't a shopping location or anything, just a business park. On what grounds would I appeal if possible? Of course in my opinion there is no chance of any financial loss to the owner.
I found the signs afterwards and took a picture. I foolishly didn't pay attention to them as I just thought it was a public road so...

    UKCPS appears to have a problem with v.a.t.

    If this is contractual charge, as they claim, it is a fee for parking and thus vatable.. Have they accounted for vat on their paper work? If not it becomes a breach of contract . No vat is payable but it can only be sufficient to compensate them for losses arising as from the breach, i.e., no staff uniforms, N.I. contributions, no electricity, business rates etc., a GPEOL in fact. In many cases this loss amounts to nil.

    Ask then for a vat invoice. If they ignore, (which they probably will), it is a useful stick with which to beat them if it gets to court.

    Be aware that yellow lines on private roads and private car parks such as supermarkets, hotels, shopping compleaxes, and motorway services have no legal status whatsoever.

    They paint them on the road to make it look pretty - that's what I think anyway. ;)
  • I would be inclined to check with the council just where the private bit starts/ends.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    Seeing as pic#2 clearly says 'Contractual Terms' and 'Parking Charge' I would definitely be asking for a VAT invoice.

    Thanks so much guys. Re the Vat, should I be sending a letter of appeal to them alongside a Vat request? I'm also not 100% sure on what basis I should be appealing? Excessive charge?

    Is there a template I should use as some of the ones I've come across seem quite technically worded and I wouldn't want to make a mistake?

    Also, I checked the council site and they have adopted the road up until the cobbled strip it seems. Just my luck I decided to park the other side of it.

    First of all, wait for them to write to you, then just send them a letter saying

    "Ref xxxxxxx

    Please provide a VAT invoice for consideration.

    Regards,
    yyyyyyyyyy"

    Give them a chance to respond, then send in the usual appeal. Insufficient signage, no loss, no authority, no keeper liability.


    Wait; I'm confused. You said you had a window ticket, but the photo claims ANPR and you've got paperwork already? So what is the timeline; when was the car parked, when did you get the letter and what was on the windscreen?

    Ah, ok. Wait until they contact you via writing (so you're responding as the Keeper, and not the Driver. They've got extra hoops to jump though).

    In the NEWBIES thread I recommend NOT appealing to any IPC firm, like UKCPS.

    Also be careful what you post here, as they read forums.
