Duplicate Statement Charge

Hi Guys, I am trying to get all my charges back from Aqua, they have a website but you can only see 6 months worth of statements.
If you want more they charge £5 per statement!! That's £5 per month....surely that's got to be illegal...
How do I get those statements?
I've got to do the same with Vanquis, they are the same group so may have the same fee.
What should I do?

    Why is that?

Only if they have merged in the last 20 minutes. Otherwise, they're still not part of the same group.
    What should I do?

    Pay the £5?

On what grounds are you wanting to reclaim the charges? You are aware that bank charges are only reclaimable in very limited circumstances?
  • Wow, am I on the right site or is this a Bankers forum?
For starters £10 with a bank gets you a years worth of statements. With Aqua I need 6 months worth of statements so that's £60.
I am reclaiming the Over limit charge... done all this before and will do it again but I'm shocked they can charge £5 for a piece of paper...and illegal just like the £34 charge for going over your limit (with a bank until recently), a total money making scam....

    Bank charges are not illegal.

You may have done it before but now you can only claim due to current hardship. This means a) you'll have to demonstrate you're in hardship, b) they're unlikely to refund more than six months charges - quite possibly less, and c) they're very unlikely to entertain a second claim.

If you're struggling you would be best to speak with one of the debt management charities and arrange an affordable repayment plan.

No, it's the credit card forum of the MSE website.

I'm still not clear on why the statement charge is illegal. But if it is, tell them that, and they will be obliged to provide it, either for free or for whatever the legal amount is they're allowed to charge.

Historic overlimit charges are very difficult to claim back, but you may be able to if you can prove you are in current financial hardship (rather than historic).

    I think you'll find it's £30.
  • All good, thanks. Bank charges are not illegal no but they can be deemed excessive and thus illegal as with the banks. Credit card companies still have to comply.
And here's a quote FROM THIS SITE

What if I don’t have the details?

Let’s be honest, how many people have all their bills going back six years? If you’ve online banking access, first see what’s available there, if not send a letter to your credit card company requesting a fully comprehensive list of all past charges. Some will send you the information if you phone, so you could try this first.

Either way, you’ve a legal right to do this under the Data Protection Act. If you don't know where to write to, MoneySavers have compiled a list of data protection addresses which should help.

Unfortunately card companies are legally allowed to charge for this info - the maximum amount is £10 - and card companies being card companies, they tend to charge the full amount. So to save time, enclose a cheque for a tenner in your letter.

This site won't allow me to post the link to prove it to you but its in this sites guide to reclaiming charges.

So I say again, isn't it illegal to charge £5 per statement?

  • So I say again, isn't it illegal to charge £5 per statement?

    I say again, no.

But you could take the approach detailed in the article you quoted, which is to do a SAR, which will cost you £10.

Just be aware that although that should give you all the data they have on you, it will not be structured in the same way that the statements would be.

Aqua charges £12 for going over your limit. The ombudsman agrees this is not excessive.

You'd be far better getting your finances under control than chasing fruitless complaints.

I was just reading that, wondering who to make the cheque payable to.. it's going to be another phone call
