In my opinion any challenge to the IAS should contain something along the lines that you expect then to confirm with the ADR regulations, likewise of contacting the PPC with the initial challenge, starts that if they reject it you expect a fully compliant adr service

and that is all the info you really needed to know , with good arguments both for an against taking it further

if you can come up with a valid legal argument in your defence as to why this should not be paid (as to why you should win as you put it), I for one would be glad to read it

I agree that it may not be a gpeol

I agree the signage may be inadequate of doesnt conform to the IPC CoP

I agree there may be no landowner contract

I agree the NTK or NTD may not conform to POFA 2012

in other words I agree the usual legal arguments may apply AFTER the fact

what I may not agree on is why you thought this should be winnable by any other means or in what legal capacity you feel it should not have been issued

if you can win this in court using legal arguments as your defence, no problem, that is what B Beavis thought, or was told , but that decision has not been made yet and was a different scenario

there are a few people who have won at the 'court of the kangaroo' or the IAS .......

most have been part of the 'skippy' lottery ... 80% % loose less than 20% win .... total random ........

a few very luck / clever people have presented the IAS with a utterly overwhelming defense ..... and had there appeal granted for reasons other than the defense:eek:

I presume the cleaner had an off day ... or just lost the book of excuses ;)
