Hi
Got a PCN from UKCPS @ 7.40pm yesterday night in Leeds City Centre! WTH, these scroungers work night shifts - arghhhh!!!!
Reason = "Without a valid permit or authority".
We was parked on private land (a single space/2space at the back of Slug and Lettuce, adjacent to public pavement and a road).
Surprisingly the car behind me didn't get a ticket and I know for sure it didn't have a permit displaying! Maybe the ticket man knows this driver i.e. works for Slug and Lettuce etc!?
Please can you direct me to the correct page/link or simply advise me on the process???
Look forward to hearing from some.

the thread is always updated and you can check when each post was updated by looking at the bottom of each post for the edit date

UKCPS will turn down your appeal
the IAS is also likely to turn down your appeal
maybe you will win in court ? if it goes that far (they have 6 years to bring a court claim)
nobody can foretell the future for these cases, especially those not using the BPA or POPLA0 -
Did it include v.a.t.? This company appears to have a problem with v.a.t.
If they claim that it is a contractual charge, (an extra fee for, for example, for parking for longer than allowed), it is vatable. If no vat is mentioned, and it got to court, you could ague that it is liquidated damage for breach of contract; no vat, but the damages cannot exceed their losses arising from the event, no staff uniforms, no office expences, not even the DVLA look up fee, so probably nil.
Ask them for a vat invoice, this will tell them that you are not a patsy, put them on the back foot, and, if this went to court, count against them.

with some PPC's you will not win first or second appeals
that is any PPC who is part of the IPC debacle ........
That does not mean that you should just ignore ........
do the first appeal and read up on forum views / advice re IAS appeals.
If ... if ...if this ever got as far as court showing some paper trail is important.
you might not win an appeal ........ but if you approach things correctly you will not loose the war .........
and no this is not fair ..........

If you appeal to the I.A.S. and they turn it dow, you will have an unsigned document so perverse, so divorced from accepted adjudication procedures ac to be a trevesty.i
If you were to show that to a Judge and state that, as no fair adjudication was in place as the law requires, he/she would have little choice but to throw out the claim.
AFAIK, that is why no claim involving an IAS kangaroo decision has ever bee put in front of a judge.
As far as I can see, there is not downside to appealing to the IAS, a loss is as good as a win.You never know how far you can go until you go too far.0 -

There are two different scenarios - use the first template appeal for either but be ready for the rejection letter that will likely arrive, and what to do next:
- if this is an IPC member parking firm, the point of appealing is merely for the keeper to 'appear reasonable' by stating their case and complaining to the retailers/landowners, in an attempt to get it cancelled. But if that does not work you will get a rejection letter from the parking firm offering IAS. DO NOT BOTHER WITH SECOND STAGE APPEAL IF POPLA IS NOT OFFERED, JUST SOAK UP THE DEBT COLLECTOR LETTERS KNOWING YOU'VE STATED YOUR CASE AND ONLY START A NEW THREAD IF YOUR PPC (not debt collector) SENDS A 'LETTER BEFORE CLAIM' OR STARTS A CLAIM.

Please don't start a thread asking if you should appeal to the IAS unless you have very rare circumstances that might make yours worth a try. I say 90% of people should NOT try! Do not hand the operator the 'advantage' of an IAS win.
What will happen if I do not bother with the IAS stage?
- you will get a series of hysterical 'pay up or else' debt collector letters, or maybe letters from the PPC themselves - see separate post about ignoring them, below.
or
- you might have to defend this if the PPC tries a small claim but at least they won't have an IAS win under their belt to brandish in their evidence. Most PPCs never try court and it's all bluff in their letters. Only the ones mentioned specifically in RED in post #1 above are 'likely' to sue, hence why you need a new thread about them.
I think it actually DOES say this when you analyse the above
some say appeal, get rejected, then you have paperwork to try to influence a judge, others say dont bother, you will have to decide what to do
but the fact remains that what I said is correct due to the feedback we have had as regards appeals to IPC members and the IAS appeals system
you may not like it, but as ralphy says, welcome to the murky world of private parking, nobody said it was fair or just

IMO, most of that advice is ill-judged. The reasons for appealing to IAS far outweigh ignoring it.
I shows you have been reasonable.
The decision will be anonymous, highly partial towards the PPC, and unfit for purposei.
It is unlikely that the PPC will take you to court lest the adjudicators decision is shown to a judge.
It costs them money.You never know how far you can go until you go too far.0
